할부거래에 관한 법률 제28조(공제조합의 설립)

① 선불식 할부거래업자는 제27조제1항제4호에 따른 공제사업을 운영하기 위하여 공정거래위원회의 인가를 받아 공제조합을 설립할 수 있다.

② 공제조합은 법인으로 하며, 주된 사무소의 소재지에서 설립등기를 함으로써 성립한다.

③ 공제조합에 가입한 자는 공제사업의 수행에 필요한 출자금 등을 공제조합에 내야 한다.

④ 공제조합의 기본재산은 조합원의 출자금 등으로 조성하되 출자금은 200억원 이상으로서 대통령령으로 정하는 규모 이상이어야 한다. 다만, 정부는 예산의 범위에서 출연(出捐)하거나 보조할 수 있다.

⑤ 공제조합의 설립인가 기준 및 절차, 운영 및 감독 등에 관하여 필요한 사항은 대통령령으로 정한다.

⑥ 공제조합에 관하여 이 법에 규정된 것을 제외하고는 「민법」 중 사단법인에 관한 규정을 준용한다.
