할부거래에 관한 법률 제31조(공제조합의 감독)

① 공정거래위원회는 필요하다고 인정하면 공제조합에 대하여 업무 및 회계에 관한 보고서의 제출 또는 그 밖에 필요한 조치를 명하거나 소속 공무원으로 하여금 공제조합의 업무 및 회계 상황을 조사하거나 장부 또는 그 밖의 서류를 검사하게 할 수 있다.

② 제1항에 따라 조사 또는 검사를 하는 공무원은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 보여 주어야 한다. <개정 2026.9.8>

③ 공정거래위원회는 공제조합의 운영 및 업무 집행 등이 법령이나 정관 등에 적합하지 아니한 경우 그 시정을 명할 수 있고, 그 밖에 소비자의 피해구제 등과 관련하여 필요한 경우에는 적합한 조치를 요구할 수 있다. <개정 2026.9.8>

④ 공정거래위원회는 공제조합의 임직원이 다음 각 호의 어느 하나에 해당하는 경우에는 관련 임직원에 대한 징계ㆍ해임을 요구하거나 해당 위반행위를 시정하도록 명할 수 있다. <개정 2026.9.8>

⑤ 제4항에 따라 공제조합이 임직원의 해임 또는 징계면직의 조치를 요구받은 경우 해당 임직원은 그 날부터 그 조치가 확정되는 날까지 직무가 정지된다. <신설 2026.9.8>
