행정절차법 제29조(청문 주재자의 제척ㆍ기피ㆍ회피)

① 청문 주재자가 다음 각 호의 어느 하나에 해당하는 경우에는 청문을 주재할 수 없다. <개정 2019.12.10>

② 청문 주재자에게 공정한 청문 진행을 할 수 없는 사정이 있는 경우 당사자등은 행정청에 기피신청을 할 수 있다. 이 경우 행정청은 청문을 정지하고 그 신청이 이유가 있다고 인정할 때에는 해당 청문 주재자를 지체 없이 교체하여야 한다.

③ 청문 주재자는 제1항 또는 제2항의 사유에 해당하는 경우에는 행정청의 승인을 받아 스스로 청문의 주재를 회피할 수 있다.
