개발이익 환수에 관한 법률 시행령 제20조(부담금의 정정 등)

① 시장ㆍ군수ㆍ구청장은 제18조에 따라 부담금을 결정한 후에 그 결정 내용에 누락 또는 오류가 있는 것을 발견한 경우에는 즉시 그 부담금을 조사하여 정정해야 한다. <개정 2013.3.23, 2020.9.8>

② 납부 의무자가 제12조제1항제5호에 따라 국가 또는 지방자치단체에 기부하기로 한 토지 또는 공공시설 등을 특별한 사유 없이 법 제18조에 따른 납부 기일까지 기부하지 아니하는 경우에는 납부 기일이 지난 날부터 1개월 이내에 그 토지 또는 공공시설 등과 관련하여 개발비용으로 산입한 금액에 해당하는 부담금을 징수한다. 이 경우 부담금의 납부 기한은 부과 고지일부터 30일로 한다. <개정 2014.7.14>

③ 제1항에 따라 부담금을 정정하는 경우와 법 제26조에 따른 행정심판 등에 따라 이미 납부된 부담금 중에 과오납금이 발생한 경우에는 부담금의 납부일부터 지급결정을 하는 날까지의 기간에 대하여 「국세기본법 시행령」 제43조의3제2항 본문에 따른 기본이자율에 따라 계산한 금액을 더하여 지급한다. <개정 2014.7.14, 2020.9.8>
