Enforcement Decree of the Restitution of Development Gains Act, Article 21 (Additional Collection of Charges)

① 법 제16조제1항에서 "특별한 사유"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다.

④ 시장ㆍ군수ㆍ구청장은 법 제7조제2항에 따라 경감한 부담금을 법 제16조제1항에 따라 추징하려면 제3항의 사유가 발생한 날부터 15일 이내에 경감한 부담금에 대한 납부고지서를 납부 의무자에게 보내야 한다. 이 경우 추징하는 부담금에 대한 납부 기한은 고지일부터 30일로 한다. <개정 2013.3.23, 2020.9.8>

⑤ 시장ㆍ군수ㆍ구청장은 법 제7조제3항에 따라 면제한 부담금을 법 제16조제1항에 따라 추징하려면 제3항의 사유가 발생한 날부터 15일 이내에 납부 의무자에게 추징을 통보해야 하며, 납부 의무자는 통보를 받은 날부터 30일 이내에 법 제11조에 따른 개발비용 산정에 필요한 명세서를 시장ㆍ군수ㆍ구청장에게 제출해야 한다. <개정 2013.3.23, 2014.7.14, 2020.9.8>
