Enforcement Decree of the Restitution of Development Gains Act, Article 8 (Exceptions to Imposition Start Date)
① 법 제9조제1항제1호 단서에서 "대통령령으로 정하는 경우"와 "대통령령으로 정하는 날"이란 다음 각 호와 같다.
(1) "Cases prescribed by Presidential Decree" and "date prescribed by Presidential Decree" in the proviso of Article 9 (1) 1 of the Act are as follows:
1. 토지 취득일부터 2년 이상이 지난 후에 토지 이용 계획 등이 변경된 경우에는 변경된 날의 2년 전에 해당하는 날
1. Where the land use plan, etc. is changed after 2 or more years have passed from the date of land acquisition: the date 2 years before the date of the change
2. 「중소기업기본법」 제2조에 따른 중소기업자가 공장부지를 조성하기 위하여 토지를 취득한 후에 토지 이용 계획 등이 변경된 경우에는 토지 이용 계획 등의 변경일
2. Where the land use plan, etc. is changed after a small and medium enterprise under Article 2 of the Framework Act on Small and Medium Enterprises acquires land to create a factory site: the date of the change of the land use plan, etc.
② 법 제9조제1항제2호에 따라 인가등의 변경으로 부과 대상 토지에 새로 편입된 토지에 대한 부과 개시 시점은 다음 각 호에서 정하는 날로 한다.
(2) The imposition start date for land newly incorporated into the land subject to charges due to a change of approval, etc. pursuant to Article 9 (1) 2 of the Act shall be the date prescribed in the following:
1. 변경인가 등을 받기 전에 제7조에 따른 토지 이용 계획 등이 변경된 경우로서 토지 이용 계획 등의 변경 전에 취득한 토지인 경우에는 취득일 또는 제1항제1호 및 제2호에 해당되는 날
1. Where the land use plan, etc. under Article 7 was changed before the change approval, etc. was obtained and the land was acquired before the change of the land use plan, etc.: the date of acquisition or the date falling under paragraph (1) 1 and 2
2. 변경인가 등을 받기 전에 제7조에 따른 토지 이용 계획 등이 변경된 경우로서 토지 이용 계획 등의 변경일부터 변경인가 등을 받기 전의 사이에 토지를 취득한 경우에는 토지를 취득한 날
2. Where the land use plan, etc. under Article 7 was changed before the change approval, etc. was obtained and the land was acquired between the date of change of the land use plan, etc. and the time before the change approval, etc. was obtained: the date of land acquisition
3. 제1호 또는 제2호 외의 토지인 경우에는 인가등의 변경일
