건축사법 제12조(유사명칭 사용 등의 금지)

① 건축사가 아닌 사람은 건축사 또는 이와 비슷한 명칭을 사용하여서는 아니 되며, 건축사사무소의 개설자가 아닌 사람은 건축사사무소 또는 이와 비슷한 명칭을 사용하여서는 아니 된다. <개정 2026.3.17>

② 건축사가 아닌 사람은 건축사업무를 수행한다는 표현을 하거나 표시를 하여서는 아니 되며, 건축사사무소의 개설자가 아닌 사람은 건축사업을 한다는 표현을 하거나 표시를 하여서는 아니 된다. <신설 2026.3.17>

③ 건축사사무소의 개설자가 될 수 없는 사람은 건축사를 고용하거나 건축사와 공동으로 건축사사무소를 개설ㆍ운영하여서는 아니 되며, 건축사 또한 건축사사무소의 개설자가 될 수 없는 사람에게 고용되거나 그 사람과 공동으로 건축사사무소를 개설ㆍ운영하여서는 아니 된다. <신설 2026.3.17>
