검사와 특별사법경찰관의 상호협력에 관한 규정 제34조(기소중지ㆍ참고인중지 처분된 자에 대한 수사)

① 특별사법경찰관은 다음 각 호의 어느 하나에 해당하는 경우에는 즉시 수사에 착수하고 관할 지방공소청 또는 지청의 검사에게 그 사실을 통보해야 한다.

② 특별사법경찰관은 기소중지된 피의자가 다른 기관에서 검거된 경우에는 즉시 그 피의자에 대한 체포영장의 집행, 호송 등 필요한 조치를 해야 한다.

③ 특별사법경찰관은 참고인중지의 경우 그 참고인이 교도소, 구치소 등에 구금되어 있는 것을 확인했을 때에는 즉시 검사에게 통보하고 출장조사, 공조수사 촉탁 등 필요한 조치에 관하여 지도ㆍ조언을 요청해야 한다.

④ 특별사법경찰관은 제1항에 따라 수사에 착수한 경우에는 피의자 등 소재발견 처리부에 이를 적어야 한다.

⑤ 제1항부터 제4항까지에 따른 기소중지ㆍ참고인중지 처분된 자에 대한 수사에 관하여 필요한 사항은 법무부령으로 정한다.
