경찰공무원 징계령 제13조(심문과 진술권)

① 징계위원회는 제12조제1항에 따라 출석한 징계등 심의 대상자에게 징계 사유에 해당하는 사실에 관한 심문을 하고 심사를 위하여 필요하다고 인정될 때에는 관계인을 출석하게 하여 심문할 수 있다.

② 징계위원회는 징계등 심의 대상자에게 진술할 수 있는 기회를 충분히 주어야 하며, 징계등 심의 대상자는 별지 제2호의2서식의 의견서 또는 말로 자기에게 이익이 되는 사실을 진술하거나 증거를 제출할 수 있다. <개정 2019.8.6>

③ 징계등 심의 대상자는 증인의 심문을 신청할 수 있다. 이 경우 징계위원회는 의결로써 그 채택 여부를 결정하여야 한다.

④ 징계등 의결을 요구한 자 또는 징계등 의결의 요구를 신청한 자는 징계위원회에 출석하여 의견을 진술하거나 서면으로 의견을 진술할 수 있다. 다만, 중징계나 중징계 관련 징계부가금 요구사건의 경우에는 특별한 사유가 없는 한 징계위원회에 출석하여 의견을 진술해야 한다. <개정 2022.3.15>

⑤ 징계위원회는 필요하다고 인정할 때에는 사실 조사를 하거나 특별한 학식ㆍ경험이 있는 사람에게 검증 또는 감정을 의뢰할 수 있다.
