공무원연금법 시행령 제39조(직제와 정원의 개정ㆍ폐지 등으로 인한 퇴직의 확인)

① 연금취급기관장은 법 제43조제1항제4호에 따라 소속 공무원이 직제와 정원의 개정ㆍ폐지 또는 예산의 감소 등으로 인하여 직위가 없어지거나 정원을 초과하는 인원이 생겨 퇴직한 경우에는 그 사유와 정원 및 현원(現員) 등을 확인할 수 있는 자료를 인사혁신처장에게 제출하여야 한다.

② 인사혁신처장은 제1항에 따라 제출된 자료를 통하여 해당 공무원의 퇴직이 법 제43조제1항제4호에 따른 퇴직에 해당하는지를 확인하고 확인서를 연금취급기관장에게 보내야 한다.
