공무원연금법 시행령 제42조(퇴직급여 산정의 특례)

① 퇴직한 공무원ㆍ군인 또는 사립학교교직원이 공무원으로 임용되어 법 제25조제2항에 따라 재직기간을 합산받은 후 공무원에서 퇴직하여 퇴직연금일시금 또는 퇴직일시금을 받으려는 경우에 그 급여액이 반납금 및 그에 대한 이자(반납금을 낸 후 해당 연도마다 1월 1일 현재 전국은행이 적용하는 정기예금금리 중 가장 높은 금리를 적용하되, 연 단위 복리로 계산한 이자를 말한다)와 재임용 후 공무원으로 재직한 기간에 해당하는 퇴직연금일시금 또는 퇴직일시금을 합한 금액보다 적은 경우에는 그 합한 금액을 지급한다.

② 공무원으로 임용되어 법 제25조제3항에 따라 복무기간을 재직기간에 산입한 후 공무원에서 퇴직하여 퇴직연금일시금 또는 퇴직일시금을 받으려는 경우에 그 급여액이 법 제67조제3항에 따른 소급기여금 및 그에 대한 「민법」 제379조에 따른 이자와 임용 후 공무원으로 재직한 기간에 해당하는 퇴직연금일시금 또는 퇴직일시금을 합한 금액보다 적은 경우에는 그 합한 금액을 지급한다.
