공유수면 관리 및 매립에 관한 법률 제39조(인가ㆍ허가등의 의제)
Public Waters Management and Reclamation Act, Article 39 (Deemed Authorization, Permission, etc.)
① 매립면허취득자가 매립실시계획의 승인을 받은 경우에는 다음 각 호의 인가ㆍ허가ㆍ승인ㆍ해제ㆍ협의ㆍ신고 등(이하 "인가ㆍ허가등"이라 한다)에 관하여 매립면허관청이 인가ㆍ허가등의 관계 행정기관의 장과 미리 협의한 사항에 대해서는 해당 인가ㆍ허가등을 받은 것으로 보며, 제38조제5항에 따른 매립실시계획의 승인 고시가 있는 때에는 관련 법률에 따른 인가ㆍ허가등의 고시ㆍ공고가 있는 것으로 본다. <개정 2010.5.31, 2011.4.14, 2014.1.14, 2016.12.27, 2017.3.21, 2017.10.31, 2020.1.29, 2020.3.31, 2022.12.27, 2023.5.16>
(1) Where a reclamation licensee obtains approval of a reclamation implementation plan, the authorizations, permissions, approvals, cancellations of designation, consultations, reports, etc. (hereinafter referred to as "authorizations, permissions, etc.") in the following subparagraphs, regarding matters on which the reclamation licensing authority has consulted in advance with the head of the relevant administrative agency responsible for such authorizations, permissions, etc., are deemed obtained, and when the approval of the reclamation implementation plan is publicly announced under Article 38 (5), the authorizations, permissions, etc. under relevant Acts are deemed publicly announced or notified:
1. 「골재채취법」 제22조에 따른 골재채취의 허가 및 같은 법 제34조제1항에 따른 골재채취단지에서의 골재채취허가
1. Permission for extraction of aggregate under Article 22 of the Aggregate Extraction Act and permission for extraction of aggregate in an aggregate extraction complex under Article 34 (1) of that Act;
2. 「국토의 계획 및 이용에 관한 법률」 제30조에 따른 도시ㆍ군관리계획의 결정, 같은 법 제56조제1항제2호ㆍ제4호에 따른 토지의 형질변경ㆍ분할 허가, 같은 법 제86조에 따른 도시ㆍ군계획시설사업의 시행자 지정 및 같은 법 제88조에 따른 도시ㆍ군계획시설사업 실시계획의 인가
2. Decision on the Si/Gun management plan under Article 30 of the National Land Planning and Utilization Act, permission for alteration of the form or quality and division of land under Article 56 (1) 2 and 4 of that Act, designation of the operator of an urban/Gun planning facility project under Article 86 of that Act, and authorization of the implementation plan of an urban/Gun planning facility project under Article 88 of that Act;
3. 「농어촌정비법」 제23조에 따른 농업생산기반시설의 사용허가
3. Permission for use of agricultural production infrastructure facilities under Article 23 of the Act on Maintenance of Rural Areas and Fishing Villages;
4. 「농지법」 제34조에 따른 농지의 전용허가 또는 협의
4. Permission or consultation for conversion of farmland under Article 34 of the Farmland Act;
5. 「도로법」 제107조에 따른 도로관리청과의 협의 또는 승인(같은 법 제36조에 따른 도로관리청이 아닌 자에 대한 도로공사 시행의 허가 및 같은 법 제61조에 따른 도로의점용 허가에 관한 것만 해당한다)
5. Consultation or approval with the road management authority under Article 107 of the Road Act (limited to permission to carry out road works by a person other than the road management authority under Article 36 of that Act and permission to occupy a road under Article 61 of that Act);
6. Permission for opening a private road under Article 4 of the Private Road Act;
7. 「사방사업법」 제14조에 따른 사방지 안에서의 벌채 등의 허가 및 같은 법 제20조에 따른 사방지의 지정해제
7. Permission for felling, etc. within an erosion control area under Article 14 of the Erosion Control Act and cancellation of designation of an erosion control area under Article 20 of that Act;
8. 「산림자원의 조성 및 관리에 관한 법률」 제36조제1항ㆍ제5항에 따른 입목벌채등의 허가ㆍ신고, 「산림보호법」 제9조제1항ㆍ제2항에 따른 산림보호구역(산림유전자원보호구역은 제외한다)에서의 행위의 허가ㆍ신고 및 같은 법 제11조제1항제1호에 따른 산림보호구역의 지정해제
8. Permission or report for felling of standing trees, etc. under Article 36 (1) and (5) of the Act on the Creation and Management of Forest Resources, permission or report for acts in a forest protection area (excluding a forest genetic resources protection area) under Article 9 (1) and (2) of the Forest Protection Act, and cancellation of designation of a forest protection area under Article 11 (1) 1 of that Act;
9. 「산지관리법」 제14조에 따른 산지전용허가 및 같은 법 제15조에 따른 산지전용신고, 같은 법 제15조의2에 따른 산지일시사용허가ㆍ신고
9. Permission for conversion of mountainous district under Article 14 of the Mountainous Districts Management Act, report for conversion of mountainous district under Article 15 of that Act, and permission or report for temporary use of mountainous district under Article 15-2 of that Act;
10. 「소하천정비법」 제10조제1항에 따른 소하천공사의 시행허가 및 같은 법 제14조에 따른 소하천의 점용허가
10. Permission to carry out small river works under Article 10 (1) of the Small River Maintenance Act and permission to occupy a small river under Article 14 of that Act;
11. 「수산자원관리법」 제47조제2항에 따른 보호수면 안에서의 공사시행 승인
11. Approval of carrying out construction within a protected water area under Article 47 (2) of the Fishery Resources Management Act;
12. 「신항만건설촉진법」 제8조제1항에 따른 신항만건설사업실시계획의 승인
12. Approval of an implementation plan for a new port construction project under Article 8 (1) of the Act on Promotion of New Port Construction;
13. 「자연공원법」 제23조에 따른 공원구역에서의 행위허가 및 같은 법 제71조에 따른 공원관리청과의 협의
13. Permission for acts within a park area under Article 23 of the Natural Parks Act and consultation with the park management authority under Article 71 of that Act;
14. 「장사 등에 관한 법률」 제27조제1항에 따른 개장허가
14. Permission to open a cemetery under Article 27 (1) of the Act on Funeral Services, etc.;
15. 「전기안전관리법」 제8조에 따른 자가용전기설비 공사계획의 인가 또는 신고
15. Authorization or report of a construction plan for private electrical facilities under Article 8 of the Electrical Safety Management Act;
16. 「초지법」 제21조의2에 따른 토지의 형질변경 등의 허가 및 같은 법 제23조에 따른 초지의 전용 허가ㆍ신고 또는 협의
16. Permission for alteration of the form or quality, etc. of land under Article 21-2 of the Grassland Act and permission, report, or consultation for conversion of grassland under Article 23 of that Act;
17. 「하수도법」 제24조에 따른 공공하수도의 점용허가
17. Permission to occupy a public sewer under Article 24 of the Sewerage Act;
18. 「하천법」 제6조에 따른 하천관리청과의 협의 또는 승인, 같은 법 제30조에 따른 하천공사의 시행허가 및 같은 법 제33조에 따른 하천의 점용허가
18. Consultation or approval with the river management authority under Article 6 of the River Act, permission to carry out river works under Article 30 of that Act, and permission to occupy a river under Article 33 of that Act;
19. 「항로표지법」 제13조제1항제1호에 따른 항로표지의 설치허가
19. Permission for installation of aids to navigation under Article 13 (1) 1 of the Aids to Navigation Act; and
20. 「항만법」 제9조제2항에 따른 항만개발사업 시행의 허가 및 같은 법 제10조제2항에 따른 항만개발사업실시계획의 승인
20. Permission to carry out a port development project under Article 9 (2) of the Harbor Act and approval of an implementation plan for a port development project under Article 10 (2) of that Act.
② 매립면허취득자가 매립실시계획의 승인을 받은 경우에는 제8조에 따른 점용ㆍ사용허가, 제10조에 따른 공유수면의 점용ㆍ사용 협의 또는 승인 및 제17조에 따른 점용ㆍ사용 실시계획의 신고 또는 승인을 받은 것으로 보며, 제38조제5항에 따른 매립실시계획 승인 고시가 있는 때에는 제17조제7항에 따른 고시가 있는 것으로 본다. <개정 2017.3.21, 2019.8.20>
(2) Where a reclamation licensee obtains approval of a reclamation implementation plan, the licensee is deemed to have obtained occupation and use permission under Article 8, consultation or approval for occupation and use of public waters under Article 10, and report or approval of an occupation and use implementation plan under Article 17, and when the approval of the reclamation implementation plan is publicly announced under Article 38 (5), the announcement under Article 17 (7) is deemed made.
③ 매립면허관청은 매립실시계획을 승인할 때 그 내용에 제1항 각 호의 어느 하나 또는 제2항에 해당하는 사항이 포함되어 있으면 매립면허취득자가 제출한 관계 서류를 갖추어 관계 행정기관의 장과 미리 협의하여야 한다. <개정 2023.5.16>
(3) When approving a reclamation implementation plan, where the contents include matters falling under any subparagraph of paragraph (1) or paragraph (2), the reclamation licensing authority shall consult in advance with the heads of relevant administrative agencies, with the relevant documents submitted by the reclamation licensee attached.
④ 제1항부터 제3항까지에서 규정한 사항 외에 인가ㆍ허가등 의제의 기준ㆍ효과 및 처리기준의 통합 고시 등에 관하여는 「행정기본법」 제24조부터 제26조까지 및 「행정절차법」 제20조제2항을 준용한다. 이 경우 「행정절차법」 제20조제2항 중 "처분기준"은 "처리기준"으로, "공표"는 "고시"로 본다. <개정 2023.5.16>
(4) In addition to matters provided in paragraphs (1) through (3), Articles 24 through 26 of the Framework Act on Administration and Article 20 (2) of the Administrative Procedures Act apply mutatis mutandis to the standards and effects of deemed authorizations, permissions, etc. and the consolidated public announcement of processing standards. In such cases, "standards for disposition" in Article 20 (2) of the Administrative Procedures Act is deemed "processing standards" and "publication" is deemed "public announcement".
