국가유공자 등 예우 및 지원에 관한 법률 시행령 제102조의2(민감정보 및 고유식별정보의 처리)

①국가보훈부장관(보훈심사위원회와 국가보훈부장관의 권한을 위임ㆍ재위임 또는 위탁받은 자를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보와 같은 법 시행령 제19조제1호, 제2호 또는 제4호에 따른 주민등록번호, 여권번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2012.6.27, 2014.8.6, 2022.1.13, 2022.5.9, 2023.5.23>

② 지방자치단체의 장(해당 권한이 위임ㆍ위탁된 경우에는 그 권한을 위임ㆍ위탁받은 자를 포함한다)은 법 및 이 영에 따른 국가유공자 및 국가유공자에 준하는 군경 등과 그 유족 또는 가족에 대한 예우 및 지원에 관한 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호에 따른 주민등록번호가 포함된 자료를 처리할 수 있다. <신설 2014.8.6>

③ 「전자정부법 시행령」 제89조제2항에 따라 신원 확인을 위한 운영기반의 운영업무를 위탁받은 기관은 이 영 제101조제3항 후단에 따른 모바일 국가보훈등록증의 발급ㆍ재발급ㆍ관리 및 진위확인을 위한 운영기반의 이용에 관한 사무를 수행하기 위하여 불가피한 경우에는 「개인정보 보호법」 제23조에 따른 건강에 관한 정보가 포함된 자료를 처리할 수 있다. <신설 2023.5.23>
