국가재정법 제90조(세계잉여금 등의 처리 및 사용계획)

① 일반회계 예산의 세입 부족을 보전(補塡)하기 위한 목적으로 해당 연도에 이미 발행한 국채의 금액 범위에서는 해당 연도에 예상되는 초과 조세수입을 이용하여 국채를 우선 상환할 수 있다. 이 경우 세입ㆍ세출 외로 처리할 수 있다. <신설 2008.12.31>

②매 회계연도 세입세출의 결산상 잉여금 중 다른 법률에 따른 것과 제48조의 규정에 따른 이월액을 공제한 금액(이하 "세계잉여금"이라 한다)은 「지방교부세법」 제5조제2항의 규정에 따른 교부세의 정산 및 「지방교육재정교부금법」 제9조제3항의 규정에 따른 교부금의 정산에 사용할 수 있다. <개정 2008.12.31>

③제2항의 규정에 따라 사용한 금액을 제외한 세계잉여금은 100분의 30 이상을 「공적자금상환기금법」에 따른 공적자금상환기금에 우선적으로 출연하여야 한다. <개정 2008.12.31>

④제2항 및 제3항의 규정에 따라 사용하거나 출연한 금액을 제외한 세계잉여금은 100분의 30 이상을 다음 각 호의 채무를 상환하는데 사용하여야 한다. <개정 2006.12.30, 2008.12.31, 2020.6.9>

⑤제2항부터 제4항까지의 규정에 따라 사용하거나 출연한 금액을 제외한 세계잉여금은 추가경정예산안의 편성에 사용할 수 있다. <개정 2008.12.31>

⑥제2항부터 제4항까지의 규정에 따른 세계잉여금의 사용 또는 출연은 그 세계잉여금이 발생한 다음 연도까지 그 회계의 세출예산과 관계없이 이를 하되, 국무회의의 심의를 거쳐 대통령의 승인을 얻어야 한다. <개정 2008.12.31, 2020.6.9>

⑦제2항부터 제5항까지의 규정에 따른 세계잉여금의 사용 또는 출연은 다른 법률의 규정에도 불구하고 「국가회계법」 제13조제3항에 따라 국가결산보고서에 대한 대통령의 승인을 얻은 때부터 이를 할 수 있다. <개정 2008.12.31, 2020.6.9>

⑧세계잉여금 중 제2항부터 제5항까지의 규정에 따라 사용하거나 출연한 금액을 공제한 잔액은 다음 연도의 세입에 이입하여야 한다. <개정 2008.12.31>

⑨ 정부는 매년 제61조에 따른 국가결산보고서의 국회제출 전까지 직전 회계연도에 발생한 세계잉여금의 내역을 산출하고 그 사용계획을 수립하여야 한다. <신설 2021.6.15>
