국가통합교통체계효율화법 시행령 제61조(처분제한대상 토지ㆍ시설 등의 양도 등)
Enforcement Decree of the National Integrated Transport System Efficiency Act, Article 61 (Transfer of Land and Facilities, etc. Subject to Disposal Restrictions)
① 복합환승센터에 입주하거나 입주하려는 시설의 운영자(이하 "복합환승센터입주업체"라 한다)는 분양받은 토지ㆍ시설 등을 법 제64조제1항에 따라 복합환승센터의 환승시설 또는 환승지원시설의 설치를 완료하기 전에 사업시행자나 복합환승센터관리기관에 양도하려는 경우에는 처분신청서에 국토교통부령으로 정하는 서류를 첨부하여 사업시행자나 복합환승센터관리기관에 제출하여야 한다. <개정 2013.3.23>
(1) Where an operator of a facility that has moved or intends to move into a multimodal transfer center (hereinafter referred to as a "multimodal transfer center tenant company") intends to transfer sold land, facilities, etc. to the project operator or the multimodal transfer center managing institution before completing installation of transfer facilities or transfer support facilities of the multimodal transfer center pursuant to Article 64 (1) of the Act, it shall submit to the project operator or multimodal transfer center managing institution an application for disposal, attached with documents prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport.
② 제1항에 따라 처분신청서를 받은 사업시행자나 복합환승센터관리기관이 해당 토지ㆍ시설 등을 매수할 수 없는 경우에는 처분신청서를 받은 날부터 국토교통부령으로 정하는 기간 내에 법 제64조제1항에 따라 양도할 대상자를 선정하여 처분신청인에게 알려야 한다. <개정 2013.3.23>
(2) Where the project operator or multimodal transfer center managing institution that has received an application for disposal under paragraph (1) cannot purchase the relevant land, facilities, etc., it shall select a person to whom to transfer pursuant to Article 64 (1) of the Act within the period prescribed by Ordinance of the Ministry of Land, Infrastructure and Transport from the date of receiving the application for disposal, and notify the applicant for disposal.
③ 사업시행자나 복합환승센터관리기관이 제2항에 따라 양도할 대상자를 선정하려는 경우에는 미리 다음 각 호의 사항을 공고한 후 입주희망자로부터 매수 신청을 받아야 한다.
(3) Where the project operator or multimodal transfer center managing institution intends to select a person to whom to transfer under paragraph (2), it shall publicly announce the following in advance and then receive purchase applications from prospective tenants:
1. 매도물건의 표시
1. A description of the property for sale;
2. 매도가격 및 대금 지불방법
2. The sale price and payment method;
3. 매수시기
3. The time of purchase;
4. 매수자의 입주자격
4. The tenancy qualifications of the purchaser;
5. 그 밖에 사업시행자나 복합환승센터관리기관이 필요로 하는 사항
5. Other matters that the project operator or multimodal transfer center managing institution requires.
④ 법 제64조제1항제3호에서 "대통령령으로 정하는 자"란 다음 각 호의 기관을 말한다. <개정 2012.1.6, 2014.3.24, 2016.5.31, 2016.10.25, 2019.4.2, 2022.2.17>
(4) The "persons prescribed by Presidential Decree" in Article 64 (1) 3 of the Act means the following institutions:
1. 「신용보증기금법」에 따른 신용보증기금
1. The Credit Guarantee Fund under the Credit Guarantee Fund Act;
2. 「기술보증기금법」에 따른 기술보증기금
2. The Korea Technology Finance Corporation under the Korea Technology Finance Corporation Act;
3. 「한국자산관리공사 설립 등에 관한 법률」에 따른 한국자산관리공사
3. The Korea Asset Management Corporation under the Act on the Establishment, etc. of the Korea Asset Management Corporation;
4. 「농업협동조합법」에 따른 농협은행
4. NH Bank under the Agricultural Cooperatives Act;
5. 「수산업협동조합법」에 따른 수협은행
5. Suhyup Bank under the Fisheries Cooperatives Act;
6. 「산림조합법」에 따른 산림조합중앙회
6. The National Forestry Cooperatives Federation under the Forestry Cooperatives Act;
7. 「중소기업진흥에 관한 법률」에 따른 중소벤처기업진흥공단
7. The Korea SMEs and Startups Agency under the Small and Medium Enterprise Promotion Act;
8. 「중소기업협동조합법」에 따른 중소기업중앙회
8. The Korea Federation of Small and Medium Businesses under the Small and Medium Enterprise Cooperatives Act;
9. 토지개발사업을 목적으로 하여 「지방공기업법」에 따라 설립된 지방공사
9. Local public corporations established under the Local Public Enterprises Act for the purpose of land development projects;
10. 사업시행자나 복합환승센터관리기관이 해당 복합환승센터를 관리하기 위하여 특히 필요하다고 인정하는 기관
10. Institutions that the project operator or multimodal transfer center managing institution deems particularly necessary for managing the relevant multimodal transfer center.
⑤ 법 제64조제2항에서 "대통령령으로 정하는 이자 및 비용"이란 다음 각 호의 금액을 말한다.
(5) The "interest and expenses prescribed by Presidential Decree" in Article 64 (2) of the Act means the following amounts:
1. 양도할 토지ㆍ시설 등의 취득가격에 그 취득일부터 양도일까지의 기간 중의 생산자물가지수를 곱하여 계산한 금액
1. The amount calculated by multiplying the acquisition price of the land, facilities, etc. to be transferred by the producer price index for the period from the date of acquisition to the date of transfer;
2. 매수에 들어간 취득세ㆍ등록세와 그 밖의 각종 세금 및 공과금. 다만, 취득자의 귀책사유로 추징된 세금은 제외한다.
2. Acquisition tax, registration tax, and other taxes and public charges incurred for the purchase. However, taxes assessed due to reasons attributable to the acquirer are excluded;
3. 양도할 토지ㆍ시설 등을 유지ㆍ보존 또는 개량하기 위하여 지출한 비용
3. Costs spent on maintaining, preserving, or improving the land, facilities, etc. to be transferred.
⑥ 법 제64조제3항에 따라 같은 조 제1항 각 호의 자가 매수한 토지ㆍ시설 등의 양도가격은, 취득가격에 제5항 각 호의 이자 및 비용을 합산한 금액으로 할 수 있다.
(6) The transfer price of land, facilities, etc. purchased by persons under each subparagraph of Article 64 (1) of the Act pursuant to paragraph (3) of that Article may be the sum of the acquisition price and the interest and expenses under each subparagraph of paragraph (5).
⑦ 법 제64조제3항에 따라 같은 조 제1항 각 호의 자가 매수한 토지ㆍ시설 등을 양도하려는 경우에는 미리 복합환승센터관리기관과 협의하여야 한다.
(7) Where persons under each subparagraph of Article 64 (1) of the Act intend to transfer land, facilities, etc. purchased pursuant to paragraph (3) of that Article, they shall consult in advance with the multimodal transfer center managing institution.
