Enforcement Decree of the National Treasury Funds Management Act, Article 40 (Advance Payment)
① 법 제26조에 따라 미리 지급할 수 있는 경비는 다음 각 호와 같다. <개정 2014.8.6, 2020.4.21, 2024.2.13, 2025.12.30>
(1) The expenses that may be paid in advance pursuant to Article 26 of the Act are as follows:
1. 외국에서 직접 구입하는 기계ㆍ도서ㆍ표본 또는 실험용 재료의 대가
1. Consideration for machinery, books, specimens, or experimental materials purchased directly abroad;
2. 정기간행물의 구입 경비
2. Expenses for purchasing periodicals;
3. 토지 또는 건물의 임대료와 용선료(傭船料)
3. Rent for land or buildings and charter fees;
4. 운임
4. Freight;
5. 봉급기준일에 전출되거나 출장ㆍ비상출동ㆍ기동훈련 참가 또는 휴가 중인 사병에게 지급하는 급여
5. Pay for enlisted soldiers who are transferred on the salary base date, or are on business trips, emergency dispatch, participation in mobile training, or leave;
6. 국가기관ㆍ지방자치단체 및 「공공기관의 운영에 관한 법률」 제4조에 따른 공공기관(이하 "국가기관등"이라 한다)에 지급하는 경비
6. Expenses paid to State agencies, local governments, and public institutions under Article 4 of the Act on the Management of Public Institutions (hereinafter referred to as "State agencies, etc.");
7. 외국에서 연구 또는 조사에 종사하는 자에게 지급하는 경비
7. Expenses paid to persons engaged in research or investigation abroad;
8. 교통이 불편한 장소에서 근무하는 사람 또는 선박 승무원에게 지급하는 급여
8. Pay for persons working in places with inconvenient transportation or ship crew;
9. 국고금 지급사무를 은행등에 위탁하는 경우 그 국고금
9. National treasury funds where the payment of national treasury funds is entrusted to a bank, etc.;
10. 업무 등의 위탁(제9호의 경우를 포함한다)에 필요한 경비

14. Price, compensation, or relocation cost of land purchased or expropriated by the State or things on such land;
15. 공사, 제조 또는 용역 계약의 대가로서 계약금액의 100분의 70(원활한 공사 진행 등에 필요하여 중앙관서의 장이 재정경제부장관과 협의한 경우에는 100분의 100)을 초과하지 않는 금액
15. As consideration for construction, manufacturing, or service contracts, an amount not exceeding 70 percent of the contract amount (100 percent where the head of a central government agency has consulted with the Minister of Economy and Finance because it is necessary for smooth progress of construction, etc.);
16. 정부가 초청한 외국인에게 국내에서 지급하는 경비
16. Expenses paid in Korea to foreigners invited by the Government;
17. 조달청에 지급하는 「조달사업에 관한 법률」 제2조제1호에 따른 조달물자의 대금
17. Price of procured goods under Article 2, subparagraph 1 of the Act on Public Procurement Business paid to the Public Procurement Service;
18. 재해 구호 및 복구에 드는 경비
18. Expenses for disaster relief and recovery.
② 제1항제9호에 따라 은행등에 공무원의 급여 지급을 위탁하는 경우에는 급여 지급일 전 3일 이내에 위탁할 은행등에 해당 금액을 미리 입금할 수 있다.
(2) Where payment of public officials' salaries is entrusted to a bank, etc. pursuant to paragraph (1) 9, the amount may be deposited in advance with the bank, etc. to be entrusted within three days before the salary payment date.
③ 제1항제15호에 따른 경비를 미리 지급하는 경우에는 계약 체결 후 계약 상대방의 청구를 받은 날부터 14일 이내에 지급하여야 한다. 다만, 불가피한 사유로 지급이 불가능하여 그 사유를 계약 상대방에게 문서로 통지한 경우에는 그러하지 아니하다.
(3) Where expenses under paragraph (1) 15 are paid in advance, they shall be paid within 14 days from the date of receiving the request of the counterparty to the contract after the contract is concluded; provided, that this shall not apply where payment is impossible due to unavoidable grounds and the counterparty to the contract has been notified of those grounds in writing.
