국민연금법 제72조(유족연금의 수급권자)
National Pension Act, Article 72 (Persons Entitled to a Survivors' Pension)
① 다음 각 호의 어느 하나에 해당하는 사람이 사망하면 그 유족에게 유족연금을 지급한다. <개정 2016.5.29>
(1) When a person falling under any of the following subparagraphs dies, a survivors' pension shall be paid to his or her survivors:
1. 노령연금 수급권자
1. A person entitled to an old-age pension;
2. 가입기간이 10년 이상인 가입자 또는 가입자였던 자
2. An insured person or former insured person whose insured period is 10 years or longer;
3. 연금보험료를 낸 기간이 가입대상기간의 3분의 1 이상인 가입자 또는 가입자였던 자
3. An insured person or former insured person for whom the period of paying pension contributions is one-third or more of the period subject to coverage;
4. 사망일 5년 전부터 사망일까지의 기간 중 연금보험료를 낸 기간이 3년 이상인 가입자 또는 가입자였던 자. 다만, 가입대상기간 중 체납기간이 3년 이상인 사람은 제외한다.
4. An insured person or former insured person for whom the period of paying pension contributions during the period from five years before the date of death to the date of death is three years or longer: Provided, That a person whose period of delinquency during the period subject to coverage is three years or longer is excluded;
5. 장애등급이 2급 이상인 장애연금 수급권자
5. A person entitled to a disability pension whose disability grade is grade 2 or higher.
② 제1항에도 불구하고 같은 항 제3호 또는 제4호에 해당하는 사람이 다음 각 호의 기간 중 사망하는 경우에는 유족연금을 지급하지 아니한다. <개정 2016.5.29>
(2) Notwithstanding paragraph (1), where a person falling under subparagraph 3 or 4 of the same paragraph dies during any of the following periods, a survivors' pension shall not be paid:
1. 제6조 단서에 따라 가입 대상에서 제외되는 기간
1. A period during which the person is excluded from coverage under the proviso of Article 6;
2. 국외이주ㆍ국적상실 기간
2. A period of emigration abroad or loss of nationality.
