국민투표법 제41조(투표참관인의 선정 등)

① 제15조에 따른 국민투표일공고일 현재 「정치자금법」 제27조에 따른 보조금 배분대상 정당(이하 이 조에서 "정당"이라 한다)은 투표참관인 및 사전투표참관인(이하 이 조에서 "투표참관인등"이라 한다)을 투표소와 사전투표소별로 2명씩 선정하여 투표참관인은 국민투표일 전 2일까지 읍ㆍ면ㆍ동선거관리위원회에, 사전투표참관인은 국민투표일 전 7일까지 구ㆍ시ㆍ군선거관리위원회에 각각 서면으로 신고하여야 한다.

② 투표참관인등은 투표소와 사전투표소마다 8명으로 하되, 제1항에 따라 선정ㆍ신고한 인원이 8명을 넘는 때에는 투표참관인은 읍ㆍ면ㆍ동선거관리위원회가, 사전투표참관인은 구ㆍ시ㆍ군위원회가 각각 추첨으로 지정한 사람을 투표참관인등으로 한다. 이 경우 투표참관인등을 신고한 정당의 수가 8개를 넘는 때에는 정당별로 1명씩 우선 선정한 후 추첨으로 8명을 지정하고, 정당의 수가 8개에 미달하되 신고한 인원이 8명을 넘는 때에는 정당별로 1명씩 선정한 사람을 우선 지정한 후 나머지 인원은 추첨하여 지정한다.

③ 제1항에 따른 투표참관인등의 신고가 없거나 선정ㆍ신고한 인원이 4명에 미달하는 때에는 투표참관인은 읍ㆍ면ㆍ동선거관리위원회가 그 투표구를 관할하는 구ㆍ시ㆍ군의 구역 안에 거주하는 투표권자 중에서, 사전투표참관인은 구ㆍ시ㆍ군위원회가 투표권자 중에서 각각 본인의 승낙을 얻어 4명이 될 때까지 선정한 사람을 투표참관인등으로 한다.
