국민투표법 제96조(국민투표자유방해죄)

National Referendum Act, Article 96 (Crime of Interfering with the Freedom of Referendums)

① 국민투표에 관하여 다음 각 호의 어느 하나에 해당하는 사람은 10년 이하의 징역 또는 500만원 이상 3천만원 이하의 벌금에 처한다.

1. 투표인ㆍ연설원을 폭행ㆍ협박 또는 유인하거나 불법으로 체포ㆍ감금한 사람

2. 이 법에 따른 연설ㆍ대담, 대담ㆍ토론회 또는 교통을 방해하거나 위계ㆍ속임수, 그 밖의 부정한 방법으로 국민투표의 자유를 방해한 사람

3. 업무ㆍ고용, 그 밖의 관계에 따라 자기의 보호ㆍ지휘ㆍ감독 하에 있는 사람에게 국민투표에 부쳐진 사항에 대하여 찬성 또는 반대하도록 강요한 사람

② 검사 또는 경찰공무원(사법경찰관리를 포함한다)이 제1항 각 호의 어느 하나에 규정된 행위를 하거나 하게 한 때에는 1년 이상 10년 이하의 징역과 5년 이하의 자격정지에 처한다.
