국제수형자이송법 제19조(외국법원 판결의 취소 등)

①법무부장관은 외국으로부터 국내이송수형자에 대한 외국법원의 확정판결이 취소되거나 선고된 자유형을 집행하지 아니하기로 확정되었다는 취지의 통지가 있는 때(외국법원의 확정판결이 수 개인 경우에는 그 전부가 취소되거나 집행할 수 없게 된 때에 한한다)에는 지체없이 서면으로 제13조제1항에 따른 국내이송명령을 철회하고, 국내이송수형자가 수용되어 있는 교도소ㆍ소년교도소ㆍ구치소 또는 그 지소(이하 "교도소등"이라 한다)의 소재지를 관할하는 지방공소청장등에게 그 국내이송수형자의 석방을 명하여야 한다. <개정 2009.3.25, 2026.3.24>

②지방공소청장등은 제1항의 규정에 의하여 법무부장관으로부터 석방명령을 받은 때에는 즉시 소속 검사에게 국내이송수형자의 석방을 명하여야 한다. <개정 2026.3.24>

③검사는 제2항의 규정에 의한 석방명령을 받은 때에는 즉시 국내이송수형자가 수용되어 있는 교도소등의 장에 대하여 그 국내이송수형자의 석방을 지휘하여야 한다.
