국제연합 평화유지활동 참여에 관한 법률 제5조(평화유지활동 참여의 결정)

① 국제연합이 평화유지활동에 대한민국의 참여를 요청하면 외교부장관은 이를 국방부장관에게 통보하고 상비부대 등의 파견에 관한 사항을 협의하여야 한다. <개정 2013.3.23>

② 정부는 상비부대 등의 파견을 위하여 해당 국가 또는 지역에 조사단을 파견하여 현지 정세, 안전 상황 등 현지의 전반적인 여건을 파악하고 이에 대한 보고서(이하 "조사활동보고서"라 한다)를 작성하여야 한다.

③ 정부는 국무회의의 심의와 대통령의 재가를 거쳐 국제연합이 요청한 평화유지활동에 국군부대를 파견할 것인지 여부, 파견 목적ㆍ규모ㆍ기간ㆍ임무 등에 대하여 결정한다.
