국토의 계획 및 이용에 관한 법률 시행령 제11조(광역도시계획의 수립을 위한 기초조사)
Enforcement Decree of the National Land Planning and Utilization Act, Article 11 (Basic Surveys for Establishing Metropolitan Plans)
①법 제13조제1항에서 "대통령령으로 정하는 사항"이란 다음 각 호의 사항을 말한다. <개정 2018.11.13>
(1) The term "matters prescribed by Presidential Decree" in Article 13 (1) of the Act means the following matters:
1. 기후ㆍ지형ㆍ자원ㆍ생태 등 자연적 여건
1. Natural conditions, such as climate, topography, resources and ecology;
2. 기반시설 및 주거수준의 현황과 전망
2. The current status and outlook of infrastructure and housing standards;
3. 풍수해ㆍ지진 그 밖의 재해의 발생현황 및 추이
3. The occurrence and trends of storm and flood damage, earthquakes and other disasters;
4. 광역도시계획과 관련된 다른 계획 및 사업의 내용
4. The contents of other plans and projects related to the metropolitan plan;
5. 그 밖에 광역도시계획의 수립에 필요한 사항
5. Other matters necessary for establishing the metropolitan plan.
②법 제13조제1항의 규정에 의한 기초조사를 함에 있어서 조사할 사항에 관하여 다른 법령의 규정에 의하여 조사ㆍ측량한 자료가 있는 경우에는 이를 활용할 수 있다.
(2) In conducting a basic survey under Article 13 (1) of the Act, where data surveyed or measured under other statutes exist on the matters to be surveyed, such data may be used.
③국토교통부장관, 시ㆍ도지사, 시장 또는 군수는 수립된 광역도시계획을 변경하려면 법 제13조제1항에 따른 기초조사사항 중 해당 광역도시계획의 변경에 관하여 필요한 사항을 조사ㆍ측량하여야 한다. <개정 2008.2.29, 2009.8.5, 2012.4.10, 2013.3.23, 2014.1.14>
(3) Where the Minister of Land, Infrastructure and Transport, a Mayor/Do Governor, or the head of a Si or Gun intends to change an established metropolitan plan, he or she shall survey or measure those matters, among the basic survey matters under Article 13 (1) of the Act, that are necessary for the change of the metropolitan plan.
④ 법 제13조제4항에 따라 구축ㆍ운영하는 기초조사정보체계(이하 "기초조사정보체계"라 한다)에서 관리하는 정보는 다음 각 호와 같다. <신설 2018.11.13>
(4) The information managed by the basic survey information system built and operated under Article 13 (4) of the Act (hereinafter referred to as the "basic survey information system") is as follows:
1. 법 제13조제1항에 따라 광역도시계획의 수립 또는 변경을 위하여 실시하는 기초조사에 관한 정보
1. Information on basic surveys conducted under Article 13 (1) of the Act to establish or change metropolitan plans;
2. 법 제20조제1항에 따라 준용하는 법 제13조제1항에 따라 도시ㆍ군기본계획의 수립 또는 변경을 위하여 실시하는 기초조사에 관한 정보(법 제20조제2항에 따라 토지적성평가 또는 재해취약성분석을 실시하는 경우에는 토지적성평가 또는 재해취약성분석에 관한 정보를 포함한다)
2. Information on basic surveys conducted under Article 13 (1) of the Act, as applied mutatis mutandis under Article 20 (1) of the Act, to establish or change urban or Gun master plans (including information on any land suitability assessment or disaster vulnerability analysis conducted under Article 20 (2) of the Act);
3. 법 제27조제1항에 따라 준용하는 법 제13조제1항에 따라 도시ㆍ군관리계획의 수립 또는 변경을 위하여 실시하는 기초조사에 관한 정보(법 제27조제2항 및 제3항에 따라 환경성 검토, 토지적성평가 또는 재해취약성분석을 실시하는 경우에는 환경성 검토, 토지적성평가 또는 재해취약성분석에 관한 정보를 포함한다)
3. Information on basic surveys conducted under Article 13 (1) of the Act, as applied mutatis mutandis under Article 27 (1) of the Act, to establish or change urban or Gun management plans (including information on any environmental review, land suitability assessment or disaster vulnerability analysis conducted under Article 27 (2) and (3) of the Act).
⑤ 기초조사정보체계의 구축ㆍ운영을 위한 자료의 수집, 입력, 유지 및 관리 등에 관한 세부적인 기준은 국토교통부장관이 정한다. <신설 2018.11.13>
(5) Detailed standards for collecting, entering, maintaining and managing data, etc. to build and operate the basic survey information system shall be determined by the Minister of Land, Infrastructure and Transport.
