국회법 제15조(의장ㆍ부의장의 선거)

① 의장과 부의장은 국회에서 무기명투표로 선거하고 재적의원 과반수의 득표로 당선된다.

② 제1항에 따른 선거는 국회의원 총선거 후 첫 집회일에 실시하며, 처음 선출된 의장 또는 부의장의 임기가 만료되는 경우에는 그 임기만료일 5일 전에 실시한다. 다만, 그 날이 공휴일인 경우에는 그 다음 날에 실시한다.

③ 제1항의 득표자가 없을 때에는 2차투표를 하고, 2차투표에도 제1항의 득표자가 없을 때에는 최고득표자가 1명이면 최고득표자와 차점자에 대하여, 최고득표자가 2명 이상이면 최고득표자에 대하여 결선투표를 하되, 재적의원 과반수의 출석과 출석의원 다수득표자를 당선자로 한다.
