Military Court Act, Article 534-5 (Matters Adjudicated by Wartime Military Courts)

① 보통군사법원은 다음 각 호의 사건을 제1심으로 심판한다.

2. 전시 군사법원이 설치되는 부대의 작전지역ㆍ관할지역 또는 경비지역에 있는 자군부대에 속하는 사람과 그 부대의 장의 감독을 받는 사람이 피고인인 사건. 다만, 그 부대에 군사법원이 설치된 경우에는 그러하지 아니하다.

3. 전시 군사법원이 설치되는 부대의 작전지역ㆍ관할지역 또는 경비지역에 현존하는 사람과 그 지역에서 죄를 범한 「군형법」 제1조에 해당하는 사람이 피고인인 사건. 다만, 피고인의 소속 부대의 군사법원이 그 지역에 있거나 그 사건에 대한 관할권이 타군(他軍) 군사법원에 있는 경우에는 그러하지 아니하다.

② 국방부 또는 각 군 본부의 보통군사법원은 제1항에도 불구하고 장성급 장교가 피고인인 사건과 그 밖의 중요 사건을 심판할 수 있다.

③ 고등군사법원은 보통군사법원의 재판에 대한 항소사건, 항고사건 및 그 밖에 법률에 따라 고등군사법원의 권한에 속하는 사건에 대하여 심판한다.
