군인사법 시행령 제22조(진급 예정 인원)

① 참모총장(해병대의 경우에는 해병대사령관을 말한다. 이하 이 조에서 같다)은 법 제29조제1항에 따라 매년 다음 진급연도의 계급별 진급 예정 인원을 국방부장관의 승인을 받아 정한다. 이 경우 준장 이하의 장교에 대해서는 각군(해병대를 포함한다. 이하 이 조에서 같다) 장교진급 선발위원회 개최 30일 전까지, 소장 이상의 장성급 장교에 대해서는 특별한 사유가 없으면 각군 장교진급 선발위원회 개최 7일 전까지 각각 승인을 받아야 한다. <개정 2017.9.5, 2026.8.3>

② 참모총장은 제1항에 따른 계급별 진급 예정 인원의 승인을 받으려는 경우에는 제18조제1항 및 제25조의2제4항에 따라 수립한 전직 또는 재보직 계획을 국방부장관에게 보고하여야 하며, 국방부장관이 그 진급 예정 인원을 승인할 때에는 전직 또는 재보직 계획을 고려하여야 한다.

③ 참모총장은 법 제29조제1항에 따라 국방부장관이 승인한 진급 예정 인원의 범위에서 각군의 계급별ㆍ병과별 진급 예정 인원을 정한다. 다만, 제15조제1항제1호 및 제3호에 따른 전문인력 직위에 대한 진급 예정 인원은 계급별 진급 예정 인원의 범위에서 병과와 관계없이 따로 정할 수 있다. <개정 2026.8.3>

④ 매 연도의 계급별 진급 예정 인원은 특별한 사유가 없으면 안정적인 인력 운영을 고려하여 일정 인원으로 정한다. 다만, 소장 이상의 장성급 장교의 계급별 진급 예정 인원은 궐원(闕員)에 따라 정한다. <개정 2017.9.5>

⑤ 제3항에도 불구하고 획득전문직위에 대한 진급 예정 인원은 군별ㆍ계급별 정원에 대한 궐원을 고려하여 병과와 관계없이 따로 정한다.
