군인사법 시행령 제58조(소청심사위원회의 심사 및 결정)

① 소청심사위원회는 필요한 경우 관계관으로 하여금 사실조사를 하게 하거나 관계 부대 또는 기관의 장에게 관련 서류의 제출을 명할 수 있다.

② 소청심사위원회의 결정은 재적위원 3분의 2 이상의 출석과 출석위원 과반수의 합의에 따르되, 의견이 나뉘어 출석위원 과반수의 합의에 이르지 못하였을 때에는 출석위원 과반수가 되기까지 소청인에게 가장 불리한 의견에 차례로 유리한 의견을 더하여 가장 유리한 의견을 합의된 의견으로 본다.

③ 소청심사위원회는 소청장을 접수한 날부터 특별한 사유가 없으면 30일 이내에 소청에 대한 결정을 하여야 한다.

④ 소청심사위원회의 결정은 다음 각 호와 같이 구분하며, 그 이유를 분명히 밝힌 결정서로 하여야 한다.
