군인사법 시행령 제9조의3(임용 비위 관련자의 합격 등 취소)

① 법 제9조의3제1항에서 "대통령령으로 정하는 비위"란 법령을 위반하여 임용시험에 개입하거나 임용시험에 부당한 영향을 주는 행위 등 임용시험의 공정성을 해치는 행위를 말한다.

② 시험실시기관의 장 또는 임용권자는 법 제9조의3제1항에 따라 합격 또는 임용 취소 처분을 하려는 경우에는 제9조의4제1항에 따른 임용비위심의위원회의 심의를 거쳐야 한다.

③ 시험실시기관의 장 또는 임용권자는 법 제9조의3제2항에 따라 제9조의4제1항에 따른 임용비위심의위원회의 회의를 개최하기 10일 전까지 다음 각 호의 사항을 당사자에게 통지해야 한다.

④ 시험실시기관의 장 또는 임용권자는 제3항에 따른 통지를 받은 당사자가 같은 항 제2호의 기한까지 소명의 기회를 포기한다는 뜻을 명백히 표시한 경우에는 소명의 기회를 주지 않을 수 있다.
