군인사법 시행령 제9조의4(임용비위심의위원회의 설치 등)

① 시험실시기관의 장 또는 임용권자는 법 제9조의3제1항에 따른 합격 또는 임용 취소 처분 여부를 심의하기 위하여 그 소속으로 임용비위심의위원회(이하 이 조에서 "심의위원회"라 한다)를 둔다.

② 심의위원회는 위원장 1명을 포함한 5명 이상 8명 이하의 위원으로 구성한다.

(2) The^ð더 Deliberation딜리버^r레이션 Committee커미티 shall섈 be비 composed컴포우즈드 of어^v브 at앳 least리스트 five^f파이^v브 and앤드 not낫 more모 than^ð댄 eight에잇 members,멤버즈 including인클루딩 one원 chairperson.체어퍼슨

③ 심의위원회의 위원장은 대령급 이상 장교 중에서 시험실시기관의 장 또는 임용권자가 지명한다.

(3) The^ð더 chairperson체어퍼슨 of어^v브 the^ð더 Deliberation딜리버^r레이션 Committee커미티 shall섈 be비 designated데지그네이티드 by바이 the^ð더 head헤드 of어^v브 the^ð디 examination이그재머네이션 administering애드미니스터^r링 agency에이전시 or오 the^ð디 appointing어포인팅 authority어^θ쏘^r러티 from^f프^r럼 among어멍 officers오^f퍼서즈 of어^v브 the^ð더 rank^r랭크 of어^v브 colonel커늘 or오 higher.하이어

④ 심의위원회의 위원은 다음 각 호의 사람으로 한다. 이 경우 제2호에 해당하는 사람 1명이 포함되어야 한다.

(4) The^ð더 members멤버즈 of어^v브 the^ð더 Deliberation딜리버^r레이션 Committee커미티 shall섈 be비 the^ð더 following^f팔로잉 persons.퍼슨즈 In인 such서치 cases,케이시즈 one원 person퍼슨 falling^f팔링 under언더 subparagraph서브패^r러그^r래^f프 2 shall섈 be비 included:인클루디드

⑤ 심의위원회의 위원장은 심의위원회를 대표하고, 그 업무를 총괄한다. 이 경우 위원장이 부득이한 사유로 직무를 수행할 수 없을 때에는 위원장이 미리 지명한 위원이 그 직무를 대행한다.

(5) The^ð더 chairperson체어퍼슨 of어^v브 the^ð더 Deliberation딜리버^r레이션 Committee커미티 shall섈 represent^r레프^r리젠트 the^ð더 Deliberation딜리버^r레이션 Committee커미티 and앤드 oversee오우^v버시 its잇츠 affairs.어^f페어즈 In인 such서치 cases,케이시즈 where웨어 the^ð더 chairperson체어퍼슨 is이즈 unable어네이블 to투 perform퍼^f폼 his히즈 or오 her허 duties두티즈 due두 to투 unavoidable어너^v보이더블 grounds,그^r라운즈 a어 member멤버 designated데지그네이티드 in인 advance어드^v밴스 by바이 the^ð더 chairperson체어퍼슨 shall섈 act액트 on안 his히즈 or오 her허 behalf.비해^f프

⑥ 심의위원회의 회의는 재적위원 과반수의 출석으로 개의하고, 출석위원 과반수의 찬성으로 의결한다.

(6) Meetings미팅즈 of어^v브 the^ð더 Deliberation딜리버^r레이션 Committee커미티 shall섈 be비 opened오우픈드 with위^ð드 the^ð디 attendance어텐든스 of어^v브 a어 majority머조^r러티 of어^v브 the^ð디 incumbent인컴번트 members멤버즈 and앤드 shall섈 adopt어답트 resolutions^r레절루션즈 with위^ð드 the^ð더 concurrence컨커^r런스 of어^v브 a어 majority머조^r러티 of어^v브 the^ð더 members멤버즈 present.프^r레전트

⑦ 심의위원회는 심의를 위하여 필요하다고 인정하는 경우에는 관계인의 출석, 의견의 제시 또는 증거물의 제출을 요구할 수 있다.

⑧ 제1항부터 제7항까지에서 규정한 사항 외에 심의위원회의 구성 및 운영 등에 필요한 사항은 시험실시기관의 장 또는 임용권자가 정한다.
