근로복지기본법 제28조(근로복지시설 설치 등의 지원)

① 국가 또는 지방자치단체는 근로자를 위한 복지시설(이하 "근로복지시설"이라 한다)의 설치ㆍ운영을 위하여 노력하여야 한다.

② 고용노동부장관은 사업의 종류 및 사업장 근로자의 수 등을 고려하여 근로복지시설의 설치기준을 정하고 사업주에게 이의 설치를 권장할 수 있다.

③ 국가 또는 지방자치단체는 사업주(사업주단체를 포함한다. 이하 이 조에서 같다)ㆍ노동조합(지부ㆍ분회 등을 포함한다. 이하 같다)ㆍ공단 또는 비영리법인이 근로복지시설을 설치ㆍ운영하는 경우에는 필요한 지원을 할 수 있다. <개정 2018.4.17>

④ 국가 또는 지방자치단체는 근로복지시설을 설치ㆍ운영하는 지방자치단체ㆍ사업주ㆍ노동조합ㆍ공단 또는 비영리법인에 그 비용의 일부를 예산의 범위에서 지원할 수 있다. <개정 2018.4.17>
