Enforcement Decree of the Agrochemicals Control Act, Article 22 (Delegation and Entrustment of Authority|50)
① 농림축산식품부장관은 법 제31조제1항에 따라 다음 각 호의 권한을 농촌진흥청장에게 위임한다. <신설 2022.11.29, 2024.4.16>
(1) Pursuant to Article 31 (1) of the Act, the Minister of Agriculture, Food and Rural Affairs delegates the following authority to the Administrator of the Rural Development Administration:
1. 법 제23조제7항에 따른 환경오염의 방지 등을 위해 필요한 조치의 마련
1. Preparation of measures necessary for preventing environmental pollution, etc. under Article 23 (7) of the Act;
2. 법 제27조의2제1항에 따른 포상금 지급(법 제21조제1항을 위반한 제조업자ㆍ원제업자ㆍ수입업자를 신고한 자에 대한 포상금 지급으로 한정한다)
2. Payment of rewards under Article 27-2 (1) of the Act (limited to payment of rewards to persons who have reported a manufacturer, technical grade active ingredient business operator, or importer who violated Article 21 (1) of the Act);
3. 제21조의5제2항에 따른 포상금 지급의 기준 등에 관한 고시(제2호에 따른 포상금 지급에 관한 사항으로 한정한다)
3. Public notification of the standards for payment of rewards, etc. under Article 21-5 (2) (limited to matters concerning payment of rewards under subparagraph 2).
② 농림축산식품부장관은 법 제31조제1항에 따라 다음 각 호의 권한을 농림축산검역본부장에게 위임한다. <신설 2022.11.29>
(2) Pursuant to Article 31 (1) of the Act, the Minister of Agriculture, Food and Rural Affairs delegates the following authority to the Director of the Animal and Plant Quarantine Agency:
1. 법 제3조의2에 따른 수출입식물방제업 신고 및 변경신고의 수리
1. Acceptance of reports and reports of changes of import/export plant pest control businesses under Article 3-2 of the Act;
2. 법 제5조제3항에 따른 수출입식물방제업자(법 제3조의2제1항 전단에 따라 수출입식물방제업의 신고를 한 자를 말한다. 이하 같다)의 지위를 승계한 자의 신고 접수
2. Receipt of reports from persons who have succeeded to the status of an import/export plant pest control business operator (meaning a person who has reported an import/export plant pest control business under the first sentence of Article 3-2 (1) of the Act; hereinafter the same applies) under Article 5 (3) of the Act;
3. 법 제6조에 따른 수출입식물방제업 폐업 신고의 수리
3. Acceptance of reports of closure of import/export plant pest control businesses under Article 6 of the Act;
4. 법 제7조제3항에 따른 수출입식물방제업자에 대한 영업소 폐쇄 명령, 영업의 전부 또는 일부의 정지 명령 및 같은 항 제5호에 따른 수출입식물검역소독처리규정의 고시
4. Orders to close business offices of, orders to suspend all or part of the business of, import/export plant pest control business operators under Article 7 (3) of the Act, and public notification of regulations on import/export plant quarantine disinfection treatment under subparagraph 5 of that paragraph;
5. 법 제23조제2항에 따른 수출입식물방제업자에 대한 교육
5. Education of import/export plant pest control business operators under Article 23 (2) of the Act;
6. 법 제24조제1항에 따른 수출입식물방제업자가 보관ㆍ사용하는 농약 또는 관계 기록정보 등에 대한 검사 및 그 검사를 위해 필요한 시료 등의 수거
6. Inspection of agrochemicals or related record information, etc. kept or used by import/export plant pest control business operators under Article 24 (1) of the Act, and collection of samples, etc. necessary for the inspection;
7. 법 제24조제5항에 따른 농약등에 대한 봉인 및 수거ㆍ폐기 명령(해당 위반자가 수출입식물방제업자인 경우로 한정한다)
7. Orders to seal, collect, and dispose of agrochemicals, etc. under Article 24 (5) of the Act (limited to cases where the violator is an import/export plant pest control business operator);
8. 법 제24조제6항에 따른 농약등에 대한 봉인 및 수거ㆍ폐기(해당 위반자가 수출입식물방제업자인 경우로 한정한다)
8. Sealing, collection, and disposal of agrochemicals, etc. under Article 24 (6) of the Act (limited to cases where the violator is an import/export plant pest control business operator);
9. 법 제25조에 따른 수출입식물방제업자에 대한 보고 요구 및 보완 명령
9. Requests for reports and orders to supplement from import/export plant pest control business operators under Article 25 of the Act;
10. 법 제28조제1항제2호에 따른 수출입식물방제업의 신고ㆍ변경신고를 하는 자 및 같은 항 제3호에 따른 수출입식물방제업자의 지위승계를 신고하는 자에 대한 수수료 징수
10. Collection of fees from persons who report or report changes of an import/export plant pest control business under Article 28 (1) 2 of the Act and persons who report succession to the status of an import/export plant pest control business operator under subparagraph 3 of that paragraph;
11. 법 제29조제1호에 따른 수출입식물방제업자의 영업소 폐쇄처분에 대한 청문
11. Hearings on dispositions closing the business offices of import/export plant pest control business operators under Article 29 1 of the Act;
12. 다음 각 목에 해당하는 자에 대한 과태료의 부과ㆍ징수
12. Imposition and collection of administrative fines on the following persons:
가. 법 제40조제1항제1호에 해당하는 자 중 수출입식물방제업을 한 자
(a) Among persons falling under Article 40 (1) 1 of the Act, persons who have engaged in an import/export plant pest control business;
나. 법 제40조제1항제2호ㆍ제4호, 같은 조 제2항제1호부터 제3호까지 및 같은 항 제5호의2ㆍ제6호ㆍ제7호에 해당하는 자 중 수출입식물방제업자
(b) Among persons falling under Article 40 (1) 2 and 4, Article 40 (2) 1 through 3, and Article 40 (2) 5-2, 6, and 7 of the Act, import/export plant pest control business operators;
13. 제21조제4항에 따른 교육의 실시에 필요한 세부사항에 관한 고시(수출입식물방제업자에 대한 교육에 관한 사항으로 한정한다)
13. Public notification of detailed matters necessary for providing education under Article 21 (4) (limited to matters concerning education of import/export plant pest control business operators).
③ 농림축산식품부장관은 법 제31조제1항에 따라 다음 각 호의 권한을 국립농산물품질관리원장에게 위임한다. <신설 2022.11.29, 2024.4.16>
(3) Pursuant to Article 31 (1) of the Act, the Minister of Agriculture, Food and Rural Affairs delegates the following authority to the Director of the National Agricultural Products Quality Management Service:
1. 법 제3조의2에 따른 항공방제업 신고 및 변경신고의 수리
1. Acceptance of reports and reports of changes of aerial pest control businesses under Article 3-2 of the Act;
2. 법 제5조제3항에 따른 항공방제업자(법 제3조의2제1항 전단에 따라 항공방제업의 신고를 한 자를 말한다. 이하 같다)의 지위를 승계한 자의 신고 접수

6. 법 제24조제1항에 따른 판매업자 및 항공방제업자가 보관ㆍ진열ㆍ판매ㆍ사용하는 농약, 농약활용기자재 또는 관계 기록정보 등에 대한 검사 및 그 검사를 위해 필요한 시료 등의 수거
6. Inspection of agrochemicals, agrochemical utilization equipment and materials, or related record information, etc. kept, displayed, sold, or used by sellers and aerial pest control business operators under Article 24 (1) of the Act, and collection of samples, etc. necessary for the inspection;
7. 법 제24조제4항에 따른 판매업자의 농약등에 대한 검사
7. Inspection of agrochemicals, etc. of sellers under Article 24 (4) of the Act;
8. 법 제24조제5항에 따른 농약등에 대한 봉인 및 수거ㆍ폐기 명령(해당 위반자가 판매업자 및 항공방제업자인 경우로 한정한다)
8. Orders to seal, collect, and dispose of agrochemicals, etc. under Article 24 (5) of the Act (limited to cases where the violator is a seller or aerial pest control business operator);
9. 법 제24조제6항에 따른 농약등에 대한 봉인 및 수거ㆍ폐기(해당 위반자가 판매업자 및 항공방제업자인 경우로 한정한다)
9. Sealing, collection, and disposal of agrochemicals, etc. under Article 24 (6) of the Act (limited to cases where the violator is a seller or aerial pest control business operator);
10. 법 제25조제1항에 따른 판매업자 및 항공방제업자에 대한 보고 요구
10. Requests for reports from sellers and aerial pest control business operators under Article 25 (1) of the Act;
11. 법 제25조제2항에 따른 항공방제업자에 대한 보완 명령
11. Orders to supplement to aerial pest control business operators under Article 25 (2) of the Act;
12. 법 제27조의2제1항에 따른 포상금 지급(법 제21조제1항을 위반한 판매업자 및 같은 조 제2항을 위반한 자를 신고한 자에 대한 포상금 지급으로 한정한다)

15. 다음 각 목에 해당하는 자에 대한 과태료의 부과ㆍ징수
15. Imposition and collection of administrative fines on the following persons:
가. 법 제40조제1항제1호에 해당하는 자 중 항공방제업을 한 자
(a) Among persons falling under Article 40 (1) 1 of the Act, persons who have engaged in an aerial pest control business;
나. 법 제40조제1항제2호ㆍ제4호, 같은 조 제2항제1호부터 제3호까지 및 같은 항 제5호의2ㆍ제6호ㆍ제7호에 해당하는 자 중 항공방제업자
(b) Among persons falling under Article 40 (1) 2 and 4, Article 40 (2) 1 through 3, and Article 40 (2) 5-2, 6, and 7 of the Act, aerial pest control business operators;
다. 법 제40조제2항제8호에 해당하는 자
(c) Persons falling under Article 40 (2) 8 of the Act;
16. 제21조제4항에 따른 교육의 실시에 필요한 세부사항에 관한 고시(항공방제업자에 대한 교육에 관한 사항으로 한정한다)
16. Public notification of detailed matters necessary for providing education under Article 21 (4) (limited to matters concerning education of aerial pest control business operators);

18. 제21조의5제2항에 따른 포상금 지급의 기준 등에 관한 고시(제12호에 따른 포상금 지급에 관한 사항으로 한정한다)

④ 국립농산물품질관리원장은 제3항에 따라 위임받은 권한의 일부를 법 제31조제2항에 따라 농림축산식품부장관의 승인을 받아 소속 기관의 장에게 재위임하거나 「농촌진흥법」 제33조에 따라 설립된 한국농업기술진흥원의 장에게 위탁할 수 있다. 이 경우 국립농산물품질관리원장은 그 재위임하거나 위탁하는 내용을 고시해야 한다. <신설 2022.11.29>
(4) The Director of the National Agricultural Products Quality Management Service may, with the approval of the Minister of Agriculture, Food and Rural Affairs under Article 31 (2) of the Act, redelegate part of the authority delegated under paragraph (3) to the head of an affiliated agency or entrust it to the head of the Korea Agricultural Technology Promotion Agency established under Article 33 of the Rural Development Act. In this case, the Director of the National Agricultural Products Quality Management Service shall publicly notify the content of the redelegation or entrustment.
⑤ 농촌진흥청장은 법 제31조제4항에 따라 법 제22조에 따른 농약등의 광고에 관련된 표준광고용어권장안의 작성 업무를 농촌진흥청장이 지정하는 제조업자ㆍ원제업자(법 제3조제1항 전단에 따라 원제업을 등록한 자를 말한다) 또는 수입업자로 구성된 단체의 장에게 위탁한다. <개정 2008.11.26, 2010.10.13, 2012.1.25, 2022.11.29>
(5) Pursuant to Article 31 (4) of the Act, the Administrator of the Rural Development Administration entrusts the work of preparing the recommended standard advertising terms related to advertisements for agrochemicals, etc. under Article 22 of the Act to the head of an organization composed of manufacturers, technical grade active ingredient business operators (meaning persons who have registered a technical grade active ingredient business under the first sentence of Article 3 (1) of the Act), or importers designated by the Administrator.
⑥ 농촌진흥청장은 법 제31조제4항에 따라 다음 각 호의 업무를 「농촌진흥법」 제33조에 따라 설립된 한국농업기술진흥원의 장에게 위탁한다. <신설 2012.1.25, 2014.2.13, 2022.2.22, 2022.11.29>
(6) Pursuant to Article 31 (4) of the Act, the Administrator of the Rural Development Administration entrusts the following duties to the head of the Korea Agricultural Technology Promotion Agency established under Article 33 of the Rural Development Act:
1. 법 제24조제1항에 따른 제조업자ㆍ원제업자ㆍ수입업자의 농약등 및 원제에 대한 검사 중 유효성분 등에 관한 분석
1. Analysis of active ingredients, etc. in the inspection of agrochemicals, etc. and technical grade active ingredients of manufacturers, technical grade active ingredient business operators, and importers under Article 24 (1) of the Act;
