농어촌마을 주거환경 개선 및 리모델링 촉진을 위한 특별법 제18조(실시계획 승인의 특례)

① 사업시행자는 정비사업 중 유지보전형 개발사업에 관한 내용이 포함된 실시계획서를 작성하여 실시계획의 승인을 신청할 수 있다. 이 경우 시장ㆍ군수ㆍ구청장은 존치 또는 리모델링되는 농어촌주택이 「주택법」 및 「건축법」의 다음 각 호의 건축 관련 기준에 적합하지 아니하더라도 대통령령으로 정하는 기준에 따라 실시계획의 승인을 할 수 있다. <개정 2016.1.19>

② 사업시행자가 제1항에 따라 실시계획을 작성하고자 하는 경우에는 존치 또는 리모델링되는 농어촌주택 소유자의 동의를 받아야 한다.
