주택법 제35조(주택건설기준 등)

① 사업주체가 건설ㆍ공급하는 주택의 건설 등에 관한 다음 각 호의 기준(이하 "주택건설기준등"이라 한다)은 대통령령으로 정한다.

② 지방자치단체는 그 지역의 특성, 주택의 규모 등을 고려하여 주택건설기준등의 범위에서 조례로 구체적인 기준을 정할 수 있다.

③ 사업주체는 제1항의 주택건설기준등 및 제2항의 기준에 따라 주택건설사업 또는 대지조성사업을 시행하여야 한다.
