주택법 제36조(도시형 생활주택의 건설기준)

① 사업주체(「건축법」 제2조제12호에 따른 건축주를 포함한다)가 도시형 생활주택을 건설하려는 경우에는 「국토의 계획 및 이용에 관한 법률」에 따른 도시지역에 대통령령으로 정하는 유형과 규모 등에 적합하게 건설하여야 한다.

② 하나의 건축물에는 도시형 생활주택과 그 밖의 주택을 복합하여 건축할 수 없다. 다만, 대통령령으로 정하는 요건을 갖춘 경우에는 그러하지 아니하다.
