Enforcement Decree of the Act on Management of the Harmfulness of Tobacco, Article 11 (Delegation of Authority)
① 식품의약품안전처장은 법 제22조에 따라 다음 각 호의 권한을 식품의약품안전평가원장에게 위임한다.
(1) Under Article 22 of the Act, the Minister of Food and Drug Safety shall delegate the following authority to the Director of the National Institute of Food and Drug Safety Evaluation:
1. 법 제12조제1항 각 호의 사항에 관한 자료(이하 "검사결과서등"이라 한다)의 접수
1. Receipt of data on the matters in each subparagraph of Article 12 (1) of the Act (hereinafter referred to as "test result reports, etc.");
2. 법 제13조에 따른 검사결과서등의 송부
2. Forwarding of test result reports, etc. under Article 13 of the Act;
3. 법 제14조제1항에 따른 검사결과서등의 검토
3. Review of test result reports, etc. under Article 14 (1) of the Act.
② 식품의약품안전처장은 법 제22조에 따라 다음 각 호의 권한을 지방식품의약품안전청장에게 위임한다.
(2) Under Article 22 of the Act, the Minister of Food and Drug Safety shall delegate the following authority to the Head of a Regional Office of Food and Drug Safety:
1. 법 제18조제1항에 따른 시정명령
1. Corrective orders under Article 18 (1) of the Act;
2. 법 제18조제2항에 따른 회수ㆍ폐기, 그 밖에 필요한 조치의 명령
2. Orders for recall, disposal or other necessary measures under Article 18 (2) of the Act;
3. 법 제18조제3항에 따른 대집행 및 비용 징수
3. Vicarious execution and collection of costs under Article 18 (3) of the Act;
4. 법 제21조제1항에 따른 보고명령 및 출입ㆍ검사ㆍ수거(제1호부터 제3호까지의 규정에 관련된 경우만 해당한다)
4. Orders to report and entry, inspection and collection under Article 21 (1) of the Act (limited to cases related to subparagraphs 1 through 3).
