도로교통법 시행령 제30조(경찰공무원이 제거한 불법부착장치의 반환 및 처리)

① 경찰서장 또는 제주특별자치도지사는 법 제49조제2항 후단에 따라 경찰공무원이 직접 제거한 같은 조 제1항제3호 및 제4호를 위반한 장치(이하 "불법부착장치"라 한다) 또는 그 매각대금을 반환하려는 경우에는 반환받을 자의 성명ㆍ주소 및 주민(법인)등록번호를 확인하여 그 자가 정당한 권리자임을 확인하여야 한다.

② 경찰서장 또는 제주특별자치도지사는 제1항에 따라 불법부착장치 또는 그 매각대금을 반환할 때에는 불법부착장치의 제거ㆍ운반ㆍ보관 또는 매각 등에 든 비용을 자동차의 소유자 또는 운전자로부터 징수할 수 있다.

③ 경찰서장 또는 제주특별자치도지사는 법 제49조제2항 후단에 따라 불법부착장치를 제거한 날부터 6개월이 지나도 불법부착장치의 소유자 또는 운전자가 반환을 요구하지 아니하는 경우에는 그 불법부착장치를 매각하여 그 대금을 보관할 수 있다.

④ 제3항에 따른 매각대금은 불법부착장치를 제거한 날부터 5년이 지나도 그 대금을 반환받을 사람을 알 수 없거나 불법부착장치의 소유자 또는 운전자가 반환을 요구하지 아니하는 경우에는 국고 또는 제주특별자치도의 금고에 귀속한다.
