도로교통법 시행령 제34조(인공구조물 등의 보관 등)

① 경찰서장은 법 제71조제2항 및 법 제72조제2항에 따라 스스로 제거한 인공구조물 등이나 그 매각대금을 보관하는 경우에는 이를 보관한 날부터 14일간 그 경찰서의 게시판에 다음 각 호의 사항을 공고하고, 행정안전부령으로 정하는 바에 따라 열람부를 작성ㆍ비치하여 관계자가 열람할 수 있도록 하여야 한다. <개정 2014.11.19, 2017.7.26>

② 경찰서장은 제1항에 따른 공고기간이 지나도 인공구조물 등의 점유자ㆍ소유자 또는 관리자(이하 "점유자등"이라 한다)를 알 수 없을 때에는 제1항 각 호의 내용을 일간신문, 관보 중 하나 이상에 공고하고 인터넷 홈페이지에도 이를 공고해야 한다. 다만, 일간신문 등에 공고할 만한 재산적 가치가 없다고 인정되는 경우에는 그렇지 않다. <개정 2020.11.24>

③ 경찰서장은 법 제71조제2항 후단 및 법 제72조제2항 후단에 따라 인공구조물 등을 매각할 때에는 다음 각 호의 어느 하나에 해당하는 경우를 제외하고는 「국가를 당사자로 하는 계약에 관한 법률」에서 정하는 바에 따라 경쟁입찰로 하여야 한다.
