도로교통법 제89조의2(경찰공무원 등의 요청에 의한 수시 적성검사)

① 경찰공무원 또는 수시 적성검사 실시 요청 대상자의 배우자ㆍ직계존비속은 제88조제1항에 따른 수시 적성검사 대상자에 해당한다고 인정할 만한 상당한 이유가 있는 사람에 대하여 경찰청장에게 수시 적성검사의 실시를 요청할 수 있다.

② 경찰청장은 제1항에 따른 요청을 받은 경우에는 해당 요청 대상자가 제88조제1항에 따른 수시 적성검사 대상자에 해당한다고 인정할 만한 상당한 이유가 있는 경우 수시 적성검사의 실시에 필요한 개인정보를 한국도로교통공단에 통보하여야 한다.

③ 누구든지 제1항에 따라 수시 적성검사 실시를 요청한 사람에 대하여 그 요청 사실을 이유로 불이익한 조치를 하여서는 아니 된다.

④ 경찰공무원은 제1항에 따른 요청을 하는 경우 직무상 알게 된 요청 대상자의 개인정보 중 요청 대상자가 제88조제1항에 따른 수시 적성검사 대상자에 해당하는지를 판단하는 데 필요한 최소한의 정보를 경찰청장에게 제공할 수 있다.

⑤ 제1항에 따른 수시 적성검사 실시 요청의 사유 및 방법, 제2항에 따른 요청 대상자의 수시 적성검사 대상 해당 여부의 판단 기준 및 절차, 한국도로교통공단에 통보하여야 하는 개인정보의 내용 및 통보 방법, 그 밖에 수시 적성검사 실시 요청 및 개인정보 통보 등에 필요한 사항은 대통령령으로 정한다.
