Monopoly Regulation and Fair Trade Act, Article 90 (Procedures for Consent Decisions)
① 공정거래위원회는 신속한 조치의 필요성, 소비자 피해의 직접 보상 필요성 등을 종합적으로 고려하여 동의의결 절차의 개시 여부를 결정하여야 한다.
(1) The Fair Trade Commission shall decide whether to commence consent decision procedures by comprehensively considering the need for prompt action, the need for direct compensation for consumer damage, and the like.
② 공정거래위원회는 동의의결을 하기 전에 30일 이상의 기간을 정하여 다음 각 호의 사항을 신고인 등 이해관계인에게 통지하거나, 관보 또는 공정거래위원회의 인터넷 홈페이지에 공고하는 등의 방법으로 의견을 제출할 기회를 주어야 한다.
(2) Before making a consent decision, the Fair Trade Commission shall set a period of at least 30 days and give interested persons, such as the person who filed the report, an opportunity to submit opinions by notifying them of the following matters or by publicly announcing them in the Official Gazette or on the website of the Fair Trade Commission, or by other means:
1. 해당 행위의 개요
1. An outline of the act concerned;
2. 관련 법령 조항
2. The relevant provisions of laws and regulations;
3. 시정방안(제89조제3항 각 호 외의 부분 후단에 따라 시정방안이 수정된 경우에는 그 수정된 시정방안을 말한다)
3. The remedies (meaning the revised remedies where the remedies have been revised under the latter part of the main clause of Article 89 (3));
4. 해당 행위와 관련하여 신고인 등 이해관계인의 이해를 돕는 그 밖의 정보. 다만, 사업상 또는 사생활의 비밀 보호나 그 밖에 공익상 공개하기에 적절하지 아니한 것은 제외한다.
4. Other information that helps interested persons, such as the person who filed the report, understand the act concerned. However, information that is not appropriate to disclose for the protection of business or private secrets or for other public interest reasons is excluded.
③ 공정거래위원회는 제2항 각 호의 사항을 관계 행정기관의 장에게 통보하고 그 의견을 들어야 한다. 다만, 제124조부터 제127조까지의 규정이 적용되는 행위에 대해서는 검찰총장, 중대범죄수사청장 또는 「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」 제16조에 따른 국가수사본부장과 협의하여야 한다. <개정 2026.9.29>
(3) The Fair Trade Commission shall notify the heads of relevant administrative agencies of the matters under the subparagraphs of paragraph (2) and hear their opinions. However, for acts to which Articles 124 through 127 apply, it shall consult with the Prosecutor General, the Commissioner of the Serious Crimes Investigation Agency, or the Head of the National Office of Investigation under Article 16 of the Act on the Organization and Operation of National Police and Autonomous Police.
④ 공정거래위원회는 동의의결을 하거나 이를 취소하는 경우에는 제59조의 구분에 따른 회의의 심의ㆍ의결을 거쳐야 한다.
(4) When the Fair Trade Commission makes or revokes a consent decision, it shall go through the deliberation and decision of the meeting classified under Article 59.
⑤ 동의의결을 받은 신청인은 제4항의 의결에 따라 동의의결의 이행계획과 이행결과를 공정거래위원회에 제출하여야 한다.
(5) An applicant who has received a consent decision shall submit to the Fair Trade Commission an implementation plan and the implementation results of the consent decision in accordance with the decision under paragraph (4).
⑥ 공정거래위원회는 제5항에 따라 제출된 이행계획의 이행 여부를 점검할 수 있고, 동의의결을 받은 신청인에게 그 이행에 관련된 자료의 제출을 요청할 수 있다.
(6) The Fair Trade Commission may check whether the implementation plan submitted under paragraph (5) is being implemented, and may request the applicant who has received the consent decision to submit data related to its implementation.
⑦ 공정거래위원회는 제6항에 따른 이행계획의 이행 여부 점검 등 동의의결의 이행관리에 관한 업무를 대통령령으로 정하는 바에 따라 조정원 또는 「소비자기본법」 제33조에 따른 한국소비자원(이하 "소비자원"이라 한다)에 위탁할 수 있다.
(7) The Fair Trade Commission may entrust duties concerning the management of the implementation of consent decisions, such as checking whether the implementation plan is being implemented under paragraph (6), to the Mediation Agency or the Korea Consumer Agency under Article 33 of the Framework Act on Consumers (hereinafter referred to as "Consumer Agency"), as prescribed by Presidential Decree.
⑧ 제7항에 따른 위탁을 받은 기관의 장은 제5항에 따라 신청인이 제출한 동의의결의 이행계획과 이행결과에 대한 이행관리 현황을 분기별로 공정거래위원회에 보고하여야 한다. 다만, 공정거래위원회의 현황 보고 요구가 있는 경우 즉시 이에 따라야 한다.
(8) The head of the institution entrusted under paragraph (7) shall report to the Fair Trade Commission quarterly on the status of managing the implementation plan and implementation results of the consent decision submitted by the applicant under paragraph (5). However, where the Fair Trade Commission requests a status report, the head shall comply immediately.
⑨ 제7항에 따른 위탁을 받은 기관의 장은 동의의결을 받은 신청인이 그 이행을 게을리하거나 이행하지 아니하는 경우에는 지체 없이 그 사실을 공정거래위원회에 통보하여야 한다.
(9) Where an applicant who has received a consent decision neglects or fails to implement it, the head of the institution entrusted under paragraph (7) shall notify the Fair Trade Commission of that fact without delay.
⑩ 제80조제4항 및 제5항의 기간은 신청인이 제89조제1항에 따라 동의의결을 신청한 경우 그 신청인 및 동일한 사건으로 심의를 받는 다른 당사자에 대하여 진행이 정지된다. 다만, 다음 각 호의 어느 하나에 해당하는 때부터 남은 기간이 진행한다. <신설 2023.6.20>
(10) Where an applicant applies for a consent decision under Article 89 (1), the periods under Article 80 (4) and (5) shall be suspended for that applicant and for other parties under deliberation in the same case. However, the remaining period shall run from any of the following times:
1. 신청인이 동의의결의 신청을 취소한 때
1. When the applicant withdraws the application for a consent decision;
2. 공정거래위원회가 동의의결 절차를 개시하지 아니하기로 결정한 때
2. When the Fair Trade Commission decides not to commence consent decision procedures;
3. 공정거래위원회가 동의의결을 하지 아니하기로 결정한 때
3. When the Fair Trade Commission decides not to make a consent decision;
4. 동의의결의 이행이 모두 완료된 때
4. When implementation of the consent decision is fully completed;
5. 동의의결이 취소된 때
5. When the consent decision is revoked.
⑪ 제89조제2항에 따른 신청방법, 의견조회 방법, 심의ㆍ의결절차, 조정원 또는 소비자원에 대한 이행관리 업무의 위탁 절차 등 그 밖의 세부 사항은 공정거래위원회가 정하여 고시할 수 있다. <개정 2023.6.20>
(11) Other details, such as the method of application under Article 89 (2), the method of seeking opinions, the deliberation and decision procedures, and the procedures for entrusting implementation management duties to the Mediation Agency or the Consumer Agency, may be determined and publicly notified by the Fair Trade Commission.
