동ㆍ서ㆍ남해안 및 내륙권 발전 특별법 제20조의3(해양관광진흥지구에서의 관계 법률의 적용 특례)

① 해양관광진흥지구에 포함된 다음 각 호의 어느 하나의 지역에서는 「국토의 계획 및 이용에 관한 법률」 제76조, 「수산자원관리법」 제52조, 「자연공원법」 제18조제2항 및 「산지관리법」 제12조에도 불구하고 대통령령으로 정하는 바에 따라 숙박시설, 음식점 등 건축물이나 그 밖의 시설의 용도ㆍ종류 및 규모 등의 제한에 관한 사항을 완화할 수 있다. 다만, 제2호에 따른 공원구역에서의 시설의 종류는 「자연공원법」 제2조제10호에 따른 공원시설로 한다.

② 해양관광진흥지구에서는 「국토의 계획 및 이용에 관한 법률」 제77조 및 제78조에도 불구하고 대통령령으로 정하는 바에 따라 건폐율 및 용적률 제한을 20퍼센트 포인트의 범위에서 완화할 수 있다.

③ 해양관광진흥지구에서 시행하는 개발사업에 대해서는 「개발이익 환수에 관한 법률」에 따른 개발부담금을 면제한다.
