동물원 및 수족관의 관리에 관한 법률 시행령 제9조(동물원 또는 수족관의 허가요건 등)
Enforcement Decree of the Act on the Management of Zoos and Aquariums, Article 9 (Permit Requirements for Zoos or Aquariums, etc.)
① 법 제8조제1항 각 호 외의 부분에서 "대통령령으로 정하는 요건"이란 별표 1에 따른 요건을 말한다.
(1) "Requirements prescribed by Presidential Decree" in the part preceding the subparagraphs of Article 8 (1) of the Act means the requirements in Attached Table 1.
② 법 제8조제1항제5호에서 "대통령령으로 정하는 사항"이란 보유동물을 활용한 교육 계획과 보유동물 복지증진 계획을 말한다.
(2) "Matters prescribed by Presidential Decree" in Article 8 (1) 5 of the Act means an education plan using held animals and a plan for improving the welfare of held animals.
③ 법 제8조제1항 또는 제2항에 따라 동물원 또는 수족관의 허가를 받거나 같은 조 제4항에 따라 변경허가를 받으려는 자는 기후에너지환경부와 해양수산부의 공동부령으로 정하는 바에 따라 허가신청서 또는 변경허가신청서에 관련 서류를 첨부하여 기후에너지환경부장관, 해양수산부장관 또는 시ㆍ도지사(이하 "허가권자"라 한다)에게 제출해야 한다. <개정 2025.10.1>
(3) A person who intends to obtain a permit for a zoo or aquarium under Article 8 (1) or (2) of the Act or a change permit under paragraph (4) of the same Article shall submit a permit application or change permit application with relevant documents attached to the Minister of Climate, Energy and Environment, the Minister of Oceans and Fisheries, or a Mayor/Do Governor (hereinafter referred to as the "permitting authority"), as prescribed by joint Ordinance of the Ministry of Climate, Energy and Environment and the Ministry of Oceans and Fisheries.
④ 법 제8조제4항에서 "대통령령으로 정하는 중요한 사항을 변경하려는 경우"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다.
(4) "Cases of changing important matters prescribed by Presidential Decree" in Article 8 (4) of the Act means any of the following:
1. 시설의 대표자 또는 소재지를 변경하려는 경우
1. Where the representative or location of the facility is to be changed;
2. 동물원의 사육시설 면적을 100분의 10 이상 줄이려는 경우
2. Where the area of the zoo's keeping facilities is to be reduced by 10 percent or more;
3. 수족관 수조의 전체 용량 또는 전체 바닥면적을 100분의 30 이상 늘리거나 줄이려는 경우
3. Where the total capacity or total floor area of aquarium tanks is to be increased or reduced by 30 percent or more;
4. 보유동물 종의 증가로 다음 각 목의 어느 하나에 해당하는 사항을 변경하려는 경우
4. Where any of the following matters is to be changed owing to an increase in species of held animals:
가. 별표 1 제2호가목2)에 따른 보유동물 질병의 예방 및 방역 관리에 관한 사항
(a) Matters concerning prevention and quarantine management of diseases of held animals under subparagraph 2 (a) 2) of Attached Table 1;
나. 별표 1 제3호가목3)에 따른 맹수나 맹독성 동물 등 위험한 동물의 관리에 관한 사항
(b) Matters concerning management of dangerous animals, such as ferocious animals or highly venomous animals, under subparagraph 3 (a) 3) of Attached Table 1;
5. 교육에 활용하는 보유동물 종의 변경으로 별표 1 제5호다목에 따른 보유동물 종 및 개체별 교육 프로그램 운영에 관한 사항을 변경하려는 경우
5. Where matters concerning operation of educational programs by species and individual of held animals under subparagraph 5 (c) of Attached Table 1 are to be changed owing to a change in the species of held animals used for education.
⑤ 제1항부터 제4항까지에서 규정한 사항 외에 동물원 또는 수족관의 허가에 필요한 사항은 기후에너지환경부장관과 해양수산부장관이 공동으로 정하여 고시한다. <개정 2025.10.1>
(5) Matters necessary for permits of zoos or aquariums, other than those prescribed in paragraphs (1) through (4), shall be jointly determined and publicly notified by the Minister of Climate, Energy and Environment and the Minister of Oceans and Fisheries.
