민사소송법 제105조(소송의 총비용에 대한 재판)

상급법원이 본안의 재판을 바꾸는 경우 또는 사건을 환송받거나 이송받은 법원이 그 사건을 완결하는 재판을 하는 경우에는 소송의 총비용에 대하여 재판하여야 한다.
