민사소송법 제63조(법정대리권의 소멸통지)

①소송절차가 진행되는 중에 법정대리권이 소멸한 경우에는 본인 또는 대리인이 상대방에게 소멸된 사실을 통지하지 아니하면 소멸의 효력을 주장하지 못한다. 다만, 법원에 법정대리권의 소멸사실이 알려진 뒤에는 그 법정대리인은 제56조제2항의 소송행위를 하지 못한다.

②제53조의 규정에 따라 당사자를 바꾸는 경우에는 제1항의 규정을 준용한다.
