민사집행법 제308조(원상회복재판)

가처분을 명한 재판에 기초하여 채권자가 물건을 인도받거나, 금전을 지급받거나 또는 물건을 사용ㆍ보관하고 있는 경우에는, 법원은 가처분을 취소하는 재판에서 채무자의 신청에 따라 채권자에 대하여 그 물건이나 금전을 반환하도록 명할 수 있다.
