별정우체국법 시행령 제37조(퇴직급여의 청구 등)

① 법 제25조의2에 따라 퇴직급여를 받으려는 사람은 퇴직급여청구서를 소속 국장에게 제출하고 소속 국장은 지체 없이 급여의 제한 사유와 그 밖에 필요한 사항을 조사ㆍ확인한 후 관할우체국장의 확인을 거쳐 연금관리단에 이송하여야 한다.

② 법 제25조의2제1항제2호에 따라 퇴직연금을 청구하는 경우에는 제1항의 퇴직급여청구서에 법 제25조의2제9항에 따라 과학기술정보통신부장관이 발급하는 확인서를 첨부하여야 한다. <개정 2013.3.23, 2017.7.26>

③ 법 제25조의2제1항제3호에 따라 퇴직연금을 청구하는 경우에는 제1항의 퇴직급여청구서에 장애 상태를 증명할 수 있는 장애진단서를 첨부하여야 한다.

④ 퇴직급여 또는 유족급여를 신청한 사람이 그 급여의 종류를 변경하거나 조기퇴직연금의 지급시기를 변경하려면 그 급여의 지급이 시작되기 전에 또는 급여의 지급일(연금인 급여의 경우에는 최초 지급일을 말한다)부터 30일 이내에 그 변경신청서를 연금관리단에 제출하여야 한다.

⑤ 제4항에 따라 급여의 종류 또는 지급시기를 변경하는 경우에는 이미 수령한 급여와 급여를 수령한 다음 날부터 반납하는 날까지의 일수에 따른 이자(해당 연도마다 1월 1일 현재 전국은행이 적용하는 정기예금금리 중 가장 높은 금리를 적용한다)를 가산하여 연금관리단에 반납하여야 한다.
