Enforcement Decree of the Act on the Management and Fostering of the Real Estate Development Business, Article 7 (Real Estate Development by Joint Business Entities)

① 법 제4조제4항에 따라 등록사업자와 공동으로 부동산개발을 하려는 토지소유자는 다음 각 호의 요건을 모두 갖추어야 한다.

1. 부동산개발의 대상이 되는 토지의 소유권을 확보하고 있을 것

1. Having해^v빙 secured시큐어드 ownership오우너쉽 of어^v브 the^ð더 land랜드 subject서브젝트 to투 real^r릴 estate이스테잇 development;디^v벨럽먼트

2. 제1호의 토지가 저당권ㆍ가등기담보권ㆍ가압류 등(이하 이 호에서 "저당권등"이라 한다)의 목적으로 되어 있는 경우에는 해당 부동산의 판매 전까지 그 저당권등을 말소할 것. 다만, 저당권등의 권리자로부터 해당 사업의 시행에 대한 동의를 받은 때에는 그러하지 아니하다.

② 제1항에 따라 공동으로 부동산개발을 하려는 토지소유자와 등록사업자는 개발된 부동산의 사용ㆍ처분, 수익의 분배, 사업비의 부담, 사업기간, 그 밖에 사업추진상의 각종 책임 등에 관하여 협약을 체결하여야 한다.

③ 국토교통부장관은 제2항에 따른 토지소유자와 등록사업자 사이의 협약 사항에 관한 표준적인 기준을 정하여 고시하고, 그에 따를 것을 권장할 수 있다. <신설 2010.4.13, 2013.3.23>
