부동산등기법 제38조(합필의 특례)

① 「공간정보의 구축 및 관리 등에 관한 법률」에 따른 토지합병절차를 마친 후 합필등기(合筆登記)를 하기 전에 합병된 토지 중 어느 토지에 관하여 소유권이전등기가 된 경우라 하더라도 이해관계인의 승낙이 있으면 해당 토지의 소유권의 등기명의인들은 합필 후의 토지를 공유(共有)로 하는 합필등기를 신청할 수 있다. <개정 2014.6.3>

② 「공간정보의 구축 및 관리 등에 관한 법률」에 따른 토지합병절차를 마친 후 합필등기를 하기 전에 합병된 토지 중 어느 토지에 관하여 제37조제1항에서 정한 합필등기의 제한 사유에 해당하는 권리에 관한 등기가 된 경우라 하더라도 이해관계인의 승낙이 있으면 해당 토지의 소유권의 등기명의인은 그 권리의 목적물을 합필 후의 토지에 관한 지분으로 하는 합필등기를 신청할 수 있다. 다만, 요역지(要役地: 편익필요지)에 하는 지역권의 등기가 있는 경우에는 합필 후의 토지 전체를 위한 지역권으로 하는 합필등기를 신청하여야 한다. <개정 2014.6.3>
