부동산투자회사법 제42조의2(토지등에의 출입)

① 국토교통부장관은 제9조제2항제2호의 사항을 확인하기 위하여 필요하면 관계 공무원으로 하여금 타인의 토지 또는 건축물(이하 "토지등"이라 한다)에 출입하게 할 수 있다.

② 제1항에 따라 타인의 토지등에 출입하려는 공무원은 출입하려는 날의 3일 전까지 그 토지등의 소유자ㆍ점유자 또는 관리인에게 그 일시와 장소를 알려야 한다. <개정 2020.6.9>

③ 일출 전이나 일몰 후에는 그 토지등 점유자의 승낙 없이 타인의 토지등에 출입할 수 없다.

④ 토지등의 점유자는 정당한 사유 없이 제1항에 따른 출입을 방해하거나 거부하지 못한다.

⑤ 제1항에 따라 타인의 토지등에 출입을 하려는 자는 그 권한을 표시하는 증표를 지니고 이를 관계인에게 내보여야 한다.

⑥ 제5항에 따른 증표에 필요한 사항은 국토교통부령으로 정한다.
