부동산투자회사법 제49조의4(협회의 설립 등)

① 자기관리 부동산투자회사ㆍ자산관리회사 또는 부동산투자자문회사는 부동산투자회사 관련 업무의 전문화와 건전한 발전을 도모하기 위하여 자기관리 부동산투자회사ㆍ자산관리회사 또는 부동산투자자문회사의 단체(이하 "협회"라 한다)를 설립할 수 있다.

(1) Self-managed셀^f프-매니지드 real^r릴 estate이스테잇 investment인^v베스트먼트 companies,컴퍼니즈 asset애셋 management매너지먼트 companies,컴퍼니즈 or오 real^r릴 estate이스테잇 investment인^v베스트먼트 advisory애드^v바이저^r리 companies컴퍼니즈 may메이 establish이스태블리시 an앤 organization오거너제이션 of어^v브 self-managed셀^f프-매니지드 real^r릴 estate이스테잇 investment인^v베스트먼트 companies,컴퍼니즈 asset애셋 management매너지먼트 companies,컴퍼니즈 or오 real^r릴 estate이스테잇 investment인^v베스트먼트 advisory애드^v바이저^r리 companies컴퍼니즈 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð디 "association")어소우시에이션 to투 promote프^r러모우트 specialization스페셜러제이션 and앤드 sound사운드 development디^v벨럽먼트 of어^v브 business비즈니스 related^r릴레이티드 to투 real^r릴 estate이스테잇 investment인^v베스트먼트 companies.컴퍼니즈

② 협회는 법인으로 한다.

(2) The^ð디 association어소우시에이션 shall섈 be비 a어 corporation.코퍼^r레이션

③ 협회는 그 주된 사무소의 소재지에서 설립등기를 함으로써 성립한다.

(3) The^ð디 association어소우시에이션 shall섈 be비 established이스태블리시트 by바이 registering^r레지스터^r링 its잇츠 establishment이스태블리시먼트 at앳 the^ð더 location로케이션 of어^v브 its잇츠 principal프^r린서플 office.오^f피스

④ 협회를 설립하려는 경우에는 자기관리 부동산투자회사ㆍ자산관리회사 또는 부동산투자자문회사 3인 이상을 발기인으로 하여 정관을 작성한 후 창립총회의 의결을 거쳐 국토교통부장관의 인가를 받아야 한다. <개정 2013.3.23>

(4) To투 establish이스태블리시 the^ð디 association,어소우시에이션 articles아터클즈 of어^v브 incorporation인코퍼^r레이션 shall섈 be비 prepared프^r리페어드 with위^ð드 at앳 least리스트 three^θ쓰^r리 self-managed셀^f프-매니지드 real^r릴 estate이스테잇 investment인^v베스트먼트 companies,컴퍼니즈 asset애셋 management매너지먼트 companies,컴퍼니즈 or오 real^r릴 estate이스테잇 investment인^v베스트먼트 advisory애드^v바이저^r리 companies컴퍼니즈 as애즈 promoters,프^r러모우터즈 a어 resolution^r레절루션 of어^v브 the^ð디 inaugural이노거^r럴 meeting미팅 shall섈 be비 obtained,어브테인드 and앤드 authorization오^θ써^r러제이션 from^f프^r럼 the^ð더 Minister미너스터 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport트^r랜스포트 shall섈 be비 obtained.어브테인드

⑤ 국토교통부장관은 다음 각 호의 어느 하나에 해당하는 사유가 있으면 협회의 설립인가를 취소할 수 있다. <개정 2013.3.23>

(5) The^ð더 Minister미너스터 of어^v브 Land,랜드 Infrastructure인^f프^r러스트^r럭처 and앤드 Transport트^r랜스포트 may메이 revoke^r리^v보우크 the^ð디 establishment이스태블리시먼트 authorization오^θ써^r러제이션 of어^v브 the^ð디 association어소우시에이션 if이^f프 any에니 of어^v브 the^ð더 following^f팔로잉 grounds그^r라운즈 exists:이그지스츠

⑥ 협회의 정관에 기재할 내용, 그 밖에 필요한 사항은 대통령령으로 정한다.

(6) Matters매터즈 to투 be비 stated스테이티드 in인 the^ð디 articles아터클즈 of어^v브 incorporation인코퍼^r레이션 of어^v브 the^ð디 association어소우시에이션 and앤드 other어^ð더 necessary네서세^r리 matters매터즈 shall섈 be비 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree.디크^r리

⑦ 협회에 관하여 이 법에서 규정한 사항을 제외하고는 「민법」중 사단법인에 관한 규정을 준용한다.

(7) With위^ð드 respect^r리스펙트 to투 the^ð디 association,어소우시에이션 the^ð더 provisions프^r러^v비전즈 of어^v브 the^ð더 Civil시^v블 Act액트 on안 incorporated인코퍼^r레이티드 associations어소우시에이션즈 shall섈 apply어플라이 mutatis뮤타티즈 mutandis,뮤탠디즈 except익셉트 as애즈 provided프^r러^v바이디드 in인 this^ð디스 Act.액트
