Enforcement Rule of the Social Welfare Services Act, Article 26 (Reports on Suspension, Resumption, or Closure of Facilities)

①법 제38조제2항의 규정에 의하여 시설의 운영을 휴지 또는 재개하거나 시설을 폐지하고자 하는 때에는 별지 제20호서식에 의한 신고서에 다음 각호의 서류를 첨부하여 휴지ㆍ재개ㆍ폐지 3월전까지 관할 시장ㆍ군수ㆍ구청장에게 제출하여야 한다. <개정 2012.8.3>

② 법 제38조제3항에 따라 시장ㆍ군수ㆍ구청장은 제1항에 따른 휴지 또는 폐지 신고를 받은 경우에는 시설 거주자의 권익을 보호하기 위하여 제1항제2호, 제2호의2 및 제2호의3의 계획에 따른 조치가 적절하게 이루어지는지를 확인하여야 하며 필요한 경우 관계 서류의 제출을 요구할 수 있다. <개정 2012.8.3>

③ 법 제38조제4항에 따라 시설 운영자는 제1항에 따른 재개신고를 한 경우에 시설 거주자의 권익을 보호하기 위하여 제1항제5호 및 제6호의 계획에 따른 조치를 성실히 이행하여야 하며 관할 시장ㆍ군수ㆍ구청장은 그 이행 여부를 주기적으로 확인하여야 한다. <신설 2012.8.3>
