Enforcement Rule of the Industrial Accident Compensation Insurance Act, Article 62 (Procedures for Applying for and Paying Lump-Sum Payment of Insurance Benefits)

① 법 제76조에 따라 보험급여를 한꺼번에 받으려는 사람이 출국을 하려는 경우에는 업무상 부상 또는 질병의 치료에 지장이 있는지에 관한 소견서를 첨부하여 공단에 신청하여야 한다. 이 경우 공단은 출국하는 시기를 미루어야 한다는 의학적 소견이 있는 경우에는 보험급여를 한꺼번에 지급하지 않을 수 있다.

② 공단은 제1항에 따른 신청을 받으면 한꺼번에 지급할 보험급여 금액의 산정을 위하여 필요하면 해당 근로자에게 법 제43조제1항제1호ㆍ제2호에 따른 산재보험 의료기관에서 다음 각 호의 사항에 관한 신체감정을 받도록 할 수 있다. 이 경우 신체감정에 드는 비용은 실비로 지급할 수 있다. <개정 2018.12.13, 2021.2.1>

③ 공단은 제2항에 따른 신체감정의 결과 등을 고려하여 한꺼번에 지급할 보험급여의 금액을 산정하여야 한다. 이 경우 신체감정의 결과의 인용 방법 및 범위 등에 대하여는 자문의사회의의 심의를 거쳐 결정할 수 있다.
